Make sure life insurance doesn’t ruin your estate plan
Life insurance is a valuable tool to protect your family, and potentially your business interests after your death. Your estate plan is the collection of legal documents that include directions about what should happen to your assets upon your death. Your estate plan could include either a Last Will and Testament or a maybe a Living Trust. One of the most common problems I discover when I review existing planning with clients or potential clients is the failure to coordinate the outcome of a will or trust and the outcome of life insurance proceeds. Let’s examine some of the potential problems this can create so that we can avoid them.

OPINION: County commissioners colluding with the Tribe?
That’s the allegation made by retired Brigadier General Blaine Holt in his July 20 CDA Press My Turn piece titled, “Theft by any other name is still theft.” In it he wrote, “is it fair for three commissioners and a 2,600-member tribe to collude to shred your net worth.” That’s a tall claim from a person who achieved the prominent rank of Brigadier General. As one of those three county commissioners, I’d appreciate seeing the General’s proof.

CLARK: Left-wing viewpoints?
A recent letter by Wylie Clark accuses The Press of “left-wing view points.” The writer suggests that the idea of a person who has “no experience in the job” and “isn’t really sure what the job entails” applies to the “Biden crime family.” He is obviously unaware that President Biden’s experience and knowledge of the job is so superior to the former president’s that such an idea is ridiculous.
BIDEN ADMINISTRATION: ‘A disaster’
In case you haven’t noticed recently the price of gasoline is back to $4 a gallon. Before Joe Biden took office gas here in Coeur d’Alene was $1.98 a gallon. Energy costs went up when the Biden Administration announced and caused domestic energy production to be curtailed and regulated to the point of strangling the industry. In case you are not aware the cost of fuel is reflected in all products that have to be shipped, trucked or sent by rail. This has been the reason that everything is going up in price and I believe inflation actually sits at 15-20% and not the 7-8% the media and the Biden Administration try to claim.
SAUSSER: Gave much to the community
I was saddened to hear of Don Sausser’s passing over the weekend. Don was a true friend of the Coeur d’Alene community. The hundreds of hours of care he took capturing and editing so many performances is a priceless contribution to all involved.
RESERVATION REZONE: More to the story
My Turn writer, John Hippler, reflecting on Dave Oliveria’s column about the history of Tubbs Hill, is proud of his father, Vern Hippler, a Coeur d’Alene city councilor “back in the day,” who with others, opposed commercial development of Tubbs Hill. Rightly proud of his dad as a “visionary,” he encourages the current Board of County Commissioners to, essentially, be like his dad and “do the right thing” regarding the question to rezone some 25,000 acres on the Coeur d’Alene Tribe’s reservation. The problem is, John didn’t get the whole story. (Kids these days; they just. don’t. listen!)

When Afghanistan fell to the Taliban in August 2021, Afghan aviators were ordered to fly their aircraft out of the country to keep them from falling into enemy hands. Over 300 pilots flew to surrounding countries, most of them having to leave their families behind. Many of those pilots have been resettled in the U.S., including 14 who now live in Idaho. They have been working multiple jobs in order to support themselves and their families back home. They would do much better if they could put their aviation skills to work.

A great book of my childhood was “Augustus and the River” about a boy on the Mississippi. ADVERTISING: Advertorial — Wine price inflation round 2
We wrote frequently during 2022 about the surging inflation in the wine industry. For much of the year the price increases were relentless and pretty much across the board for wines from every appellation New World and Old World alike. Through the first half of 2023 things seemed to stabilize. There were still some price increases but they were more moderate in nature and not every bottle that came through the door went up. Even more refreshingly we saw some wine come in down a “tick or two” at the wholesale level. We were relieved, and I’m sure most wine consumers were as well.

Real Estate, LLCs and Living Trusts: What goes where?
One of the most important parts of having a living trust designed to avoid probate is to have those assets which would normally require probate assigned to the trust. By this I mean that the trust needs to be the owner of the probate-causing assets (more technically, the Trustee of the trust is the owner, but in his or her capacity as Trustee). In Idaho, one asset that will almost always implicate the need for a probate after death is real estate. So, when I help clients establish a living trust for estate planning, I also assist them in getting their real estate retitled into their trust. This typically means preparing, executing, and recording a new deed for the client’s personal residence which names the trust as the titled owner of the property going forward (again, technically, the deed shows the Trustee of the trust as the titled owner, but in their capacity as Trustee of said trust). If a client owns more than one residence, we will be repeating this process for each.

Director Alexa Eccles explained that it will be nearly impossible to make enough cuts to balance the budget. Accepting a tax increase with less drastic budget cuts would best serve the community’s needs.

LEGISLATORS: Want to take away your rights
“Think of the children!” Since an anti-library bill (H.B. 314) failed, people across the state are attempting to control not only public libraries but the Idaho people as well. While ranting about safety, they ignore the unlimited benefits of public libraries that cannot be replaced. Nowhere else can you go to borrow any book ever published, completely free, through interlibrary loan. Nowhere else can you borrow a computer if yours can’t do the job. Nowhere else can you have such endless information in one building.
AP HEADLINE: Was biased
Regarding the article in the July 13 issue with headline “Estate of anti-fascist files wrongful death suit.” The article is produced by the Associated Press. I am not sure who decided on the headline. How the individual in question could be referred to as an ‘anti-fascist’ is incomprehensible. Such an incorrect headline and clearly biased. The individual did not wish for anyone to have an opinion other than his and attempted to kill a person due to their point of view.

OPINION: Why file a lawsuit over deceptive initiative titles?
It is said that you can’t judge a book by its cover, which often turns out to be true, but you have to read the book to learn the truth. However, if the cover is the only thing you ever see, it can give you a false impression as to the content of the book. The same thing happens when voters are asked to sign an initiative petition. The titles, which Idaho law requires to be true and impartial, may well influence whether voters will add their signature to the petition or vote for it on election day. Misleading titles can help sink a worthy initiative. That's why Idahoans for Open Primaries (IOP) has filed suit to change the deceptive titles that the Attorney General’s office conjured up for the Open Primaries Initiative.

Sommelier, winemaker, brother-in-law and friend John Lancaster was in town for a visit this past week, and as we often do, we talked a lot about wine, drank some great wine and also discussed the business of wine. There was one conversation that was certainly memorable and for me column worthy. It centered on vintages, and more specifically discussing the really great years in our collective memory.

ADVERTISING: Advertorial — The important role of cholesterol in health
According to the U.S. Center for Disease Control and Prevention, over 78 million Americans, just over a third of all adults, are on a statin (cholesterol-lowering) drug. We are convinced as a society that cholesterol is bad, and that elevated levels are a direct path to cardiovascular and heart disease. But is this true? And if so, why would a substance so intrinsic to our health be the driver of disease?

HOUSING: More ‘right-size’ options needed
I prefer progress over regression but as I age I recognize the limits of my current home. I foresee a time soon when I will need to return to apartment living instead of the single family ranch-style home I currently enjoy. I call this a regression only because I will be returning to a living arrangement I had during my younger years just starting out. While I am too healthy for assisted living, I am too feeble for routine home maintenance like climbing ladders… and herein lays the problem: There are virtually no new 3 to 4 bedroom apartments in Kootenai County. While I applaud the construction of “starter homes” and 1 to 2 bedroom apartments, I lament there are few options for established families wanting larger apartments or condominiums (without luxury pricing).

TRAFFIC CENTER: Real goal is control, not safety
Benjamin Franklin once said: “Those who would give up essential liberty, to purchase a little temporary safety, deserve neither liberty nor safety.” There are those who would argue that his statement has lost its context in the 21st Century. Oh sure, it may have been said during a controversy regarding the state’s authority to levy a property tax in Pennsylvania, but the premise holds true in all situations where the citizens are promised “safety” in exchange for their freedoms.

Thank you, Coeur d’Alene Press and Kaye Thornbrugh, for your thorough coverage of the ongoing and disheartening situation at North Idaho College. Thankfully, once again, the college has been provided a temporary delay in its seemingly inevitable path toward losing accreditation. SHED ROOFS: They’re everywhere
I have been in construction my whole adult life and when I was a kid back in the ’50s the only time you saw a shed roof was of course on a shed. Reason being for this is that they were cheap for the farmer to build and required marginal skills to build it.

It will also indicate who will be in charge of carrying out those instructions, without the need for the involvement of a probate court judge.
