WHEREAS, Idaho Code § 23-1012 prohibits the sale of beer and/or wine consumed on a business’s premises after one o’clock (1:00) a.m. until six o’clock (6:00) a.m.; and WHEREAS, Idaho Code § 23-927 prohibits the sale of liquor by the drink on Sunday, Memorial Day, Thanksgiving, and Christmas from one o’clock (1:00) a.m. until ten o’clock (10:00) a.m. the following day and prohibits the sale of liquor by the drink after one o’clock (1:00) a.m. until ten o’clock (10:00) a.m. on any other day; and WHEREAS, Idaho Codes §§ 23-1012 and 23-927 also permit cities to extend the hours of the sale of liquor by the drink and/or beer and wine consumed on a business’s premises within the city’s boundaries from one o’clock (1:00) am to two o’clock (2:00) a.m. through passage of an ordinance; and WHEREAS, Idaho Code § 23-927 also permits cities to allow the sale of liquor by the drink by businesses within the city’s boundaries on Sunday, Memorial Day, and Thanksgiving through passage of an ordinance; and WHEREAS, the Mayor and City Council of Smelterville wish to extend the hours and days for the sale of liquor by the drink and beer or wine consumed on the premises of businesses within the city’s boundaries in the best interest of the city, its residents, and liquor license holders. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF SMELTERVILLE, SHOSHONE COUNTY, STATE OF IDAHO: Section 1: INTERFERENCE WITH ROAD MAINTENANCE - It shall be unlawful for any person to park, abandon, or otherwise leave unattended any vehicle or trailer, as defined in Idaho Statute, Chapter 1, Title 49 or any other personal property on any City right-of-way at any time or in any manner which will obstruct or hinder any city employee, emergency vehicle, or city contractor during road maintenance operations. Owners of vehicles or property parked or placed in violation of this section shall be subject to towing pursuant to Section 5 of this Code. Section 2: INTERFERENCE WITH SNOW REMOVAL - It shall be unlawful for any person to park, abandon, or otherwise leave unattended any vehicle or trailer, as defined by Idaho Statute, Chapter 1, Title 49 or any other personal property on any city right-of-way at any time or in a manner which will obstruct or hinder any city employee, city contractor, or state employee engaged in snow removal operations. Snow removal operations shall be deemed completed at such time as the full width of the street right of way has been restored, absent necessary snow accumulation/storage not to exceed two feet on either or both edges of said right of way. Section 3: LIABILITY OF OWNER FOR DAMAGE OF GOVERNMENT PROPERTY; DISCLAIM OF LIABILTY - Owners of vehicles or other property parked or placed in violation of this ordinance shall also be held liable for any damage to any City, State, or County snow removal equipment, which may occur due to contact with said vehicle, trailer, or property. Further, the City of Smelterville shall not be held liable for damage to any vehicles or property parked or placed in violation to this section. Section 4: SNOW DEPOSITED ON ROADWAY OR RIGHT OF WAY PROHIBITED - Snow may not be dumped, deposited, placed, or pushed onto a city street or public right-of-way from other locations including but not limited to, privately owned property, driveway(s), and/or vehicles. Snow removed from private property may not be piled or accumulated as to block or cover any fire hydrant, street sign, culvert, inlets, outlets, or other drainage structure. Section 5: VIOLATIONS A. Any person violating any of the provisions of Sections 1 or 2, above, shall be subject to having the intervening vehicle or trailer towed by a local towing company. All costs for the execution, storage, and/or fees for towing of any vehicle shall be the sole responsibility of the owner of such vehicle. B. Any person who repeatedly violates any Section of this Code shall be guilty of an infraction and shall be punished by a fine not to exceed one hundred dollars ($100.00) for each such violation. It shall be deemed a separate offense for each day, or portion thereof, that a violation of this chapter persists, continues, or is permitted. Violations of this ordinance may be attributed to the owner of the violating property, the registered owner of the violating vehicle, or any individual in control of the same. PUBLIC NOTICE KOOTENAI COUNTY PUBLIC TRANSPORTATION FY26 PROGRAM OF PROJECTS Section 5307 Notice is hereby given that the Public Transportation System in Kootenai County intends to establish its 2026 Program of Projects (POP) and Budget, funded under 49 U.S.C.
