VERIFIED COMPLAINT Case No. CV28-24-5662 Fee Category: EXEMPT IN THE DISTRICT COURT OF THE FIRST JUDICIAL DISTRICT OF THE STATE OF IDAHO, IN AND FOR KOOTENAI COUNTY STATE OF IDAHO, ex rel. Industrial Commission, Plaintiff, vs. JD’S BY THE LAKE LLC, an Idaho Limited Liability Company, dba JD’S PUB & GRILL; and THOMAS B. CLARY, Member in his official and individual capacity, Defendants. COMES NOW the Plaintiff, State of Idaho, acting through its Industrial Commission,  by and through undersigned counsel, and complains of Defendants and alleges as follows, all upon information and belief: I. Plaintiff Industrial Commission is a state agency organized and existing under and in  accordance with the laws of the State of Idaho and is authorized to bring this action pursuant  to Idaho Code § 72-319. II. Plaintiff is informed and believes that Defendant JD’s By the Lake LLC is an Idaho limited liability company. III. Under Idaho Code § 72-301, Defendant JD’s By the Lake LLC, as an employer, was  and is required to secure the payment of compensation for its employees either by obtaining a  policy of worker’s compensation insurance, or by obtaining the approval of Plaintiff as a selfinsured employer. IV. Upon information and belief, at all times relevant hereto, Defendant Thomas B. Clary  was an officer, employee, or manager of JD’s By the Lake LLC, who had and has the  authority to secure payment of worker’s compensation on behalf of JD’s By the Lake LLC.  Upon information and belief, Defendant Thomas B. Clary is, therefore, personally liable for  the penalties sought herein, pursuant to Idaho Code § 72-319(4).  V. Jurisdiction is conferred upon this Court to hear this matter pursuant to Idaho Code §  72-319, and said section further provides that Kootenai County is an appropriate venue for  these proceedings. VI. Upon information and belief, at all times relevant hereto, Defendants operated a  business in Kootenai County, Idaho, under the business name of JD’s By the Lake LLC.  Upon information and belief, while operating said business, Defendants employed individuals to work and provide services under Defendants’ direction and control within the State of Idaho. VII. Upon information and belief, from on or about November 4, 2022, to May 3, 2023, Defendants failed to provide worker’s compensation insurance for employees of JD’s By the Lake LLC and did not obtain the approval of Plaintiff to function as a self-insured employer. VIII. Upon information and belief, Defendants failed to secure the payment of compensation as required by law, and as employers are therefore liable pursuant to Idaho Code § 72-319(4) for a penalty for each day during which such failure has continued, in the amount of Two Dollars ($2.00) per employee per day or Twenty-five Dollars ($25.00) per day, whichever amount is greater. In this case, $25 per day is the greater penalty. Plaintiff is informed and believes that the aggregate amount of said penalty accrued from November 4, 2022 to May 3, 2023 is $5,068.00. Plaintiff is entitled to an award of such sum should this matter be uncontested and proceed to default judgment. Should this matter be contested, Plaintiff is entitled to recover the statutory penalty in such sum as is demonstrated by the proof. IX. In addition to the above-referenced penalty, under the provisions of Idaho Code § 72- 319(5) and Idaho Rules of Civil Procedure 65(d)(2), Plaintiff is entitled to obtain and enforce  an injunction preventing Defendants, as well as their officers, agents, employees, attorneys,  and any other persons acting in concert or participation with them, from carrying on or  operating their business without securing the payment of compensation required by Idaho  Code § 72-301. X. Plaintiff is entitled to an award of its costs and a reasonable attorney fee of $750.00, if  this matter proceeds through default pursuant to Idaho Code §12-120(1) or §12-117.  Pursuant to Idaho Code §12-120(1), the amount pleaded is thirty-five thousand dollars  ($35,000.00) or less. Written demand for the payment of the statutory penalty was made on  the Defendants not less than ten (10) days before the commencement of the action and  Defendants have not tendered to the Plaintiff during that time an amount at least equal to  ninety-five percent (95%) of the statutory penalty that Plaintiff is above. If this matter is contested, then costs and attorney fees should be awarded in such sum  as the Court determines to be just and reasonable under the circumstances. PRAYER WHEREFORE, Plaintiff prays for judgment against Defendants as follows: 1. That Plaintiff be awarded damages against Defendants in the amount of the penalty  authorized by law; should this matter be uncontested and proceed to default judgment, said  amount shall be the sum of $5,068.00. Should the matter be contested, said amount shall be  in such sum as is demonstrated by the proof. In either case, the total sum will be $35,000.00  or less; 2. That Defendants be enjoined and restrained from operating a business with employees,including the operation of JD’s By the Lake LLC, while any default under Idaho Code § 72-301 exists; to wit, the failure to secure the payment of compensation to protect their Idaho  workers; 3. That Plaintiff be awarded its costs, and a reasonable attorney fee of $750.00, if this  matter proceeds through default pursuant to Idaho Code §12-120(1) and §12-117. If this  matter is contested, then costs and attorney fees should be in such amount as the Court  determines to be just and reasonable under the circumstances; and 4.
