STATE TIMBER SALE  CR225079, WEST LATOUR    A public oral auction will be conducted at the Idaho Department of Lands office, 3258 W. Industrial Loop, Coeur d’Alene, ID 83815, at 11:00 a.m. local time, on Tuesday, September 3, 2024, for an estimated 6,190 MBF of timber marked or otherwise designated for cutting. IV. Upon information and belief, at all times relevant hereto, Defendant Thomas B. Clary  was an officer, employee, or manager of JD’s By the Lake LLC, who had and has the  authority to secure payment of worker’s compensation on behalf of JD’s By the Lake LLC.  Upon information and belief, Defendant Thomas B. Clary is, therefore, personally liable for  the penalties sought herein, pursuant to Idaho Code § 72-319(4).  V. Jurisdiction is conferred upon this Court to hear this matter pursuant to Idaho Code §  72-319, and said section further provides that Kootenai County is an appropriate venue for  these proceedings. VI. Upon information and belief, at all times relevant hereto, Defendants operated a  business in Kootenai County, Idaho, under the business name of JD’s By the Lake LLC.  Upon information and belief, while operating said business, Defendants employed individuals to work and provide services under Defendants’ direction and control within the State of Idaho. VII. Upon information and belief, from on or about November 4, 2022, to May 3, 2023, Defendants failed to provide worker’s compensation insurance for employees of JD’s By the Lake LLC and did not obtain the approval of Plaintiff to function as a self-insured employer. VIII. Upon information and belief, Defendants failed to secure the payment of compensation as required by law, and as employers are therefore liable pursuant to Idaho Code § 72-319(4) for a penalty for each day during which such failure has continued, in the amount of Two Dollars ($2.00) per employee per day or Twenty-five Dollars ($25.00) per day, whichever amount is greater. In this case, $25 per day is the greater penalty. Plaintiff is informed and believes that the aggregate amount of said penalty accrued from November 4, 2022 to May 3, 2023 is $5,068.00. Plaintiff is entitled to an award of such sum should this matter be uncontested and proceed to default judgment. Should this matter be contested, Plaintiff is entitled to recover the statutory penalty in such sum as is demonstrated by the proof. IX. In addition to the above-referenced penalty, under the provisions of Idaho Code § 72- 319(5) and Idaho Rules of Civil Procedure 65(d)(2), Plaintiff is entitled to obtain and enforce  an injunction preventing Defendants, as well as their officers, agents, employees, attorneys,  and any other persons acting in concert or participation with them, from carrying on or  operating their business without securing the payment of compensation required by Idaho  Code § 72-301. Lacy Lemoosh Draft EA Comment Period Legal Ad  Coeur d’Alene Press  Legal Notice of Draft Environmental Assessment Comment Period 30-Day Notification and 60-Day Notification for openings greater than 40 acres for the Lacy Lemoosh Project, USDA Forest Service, Idaho Panhandle National Forests, St. Joe Ranger District. The District is seeking public comments on the 16,116-acre project area, which is on National Forest System lands located in all or part of sections 12, 13 and 24 in T43N., R 3W.; sections 1, 2, 4, 7, 9 -28, and 34-36 in T43N., R 2W.; sections 6, 7, 17-20, 29-32 in T43N., R 1W (Boise Meridian). The forested project site is within the Charlie Creek and Upper Santa Creek subwatersheds, which are tributaries of the St Maries River and flow into the St Joe River. Objectives are to improve forest health and resiliency to disturbances such as wildfire, drought, insects or diseases ; reduce hazardous fuels within the wildland urban interface (WUI) and other areas to lessen the severity of wildfires and to enable safe fire suppression efforts; provide economic benefit to local communities through sustainable use of natural resources and benefits for local communities; and reduce sediment delivery to streams from forest routes to maintain or improve Total Maximum Daily Load (TMDL) related water quality concerns and recover degraded aquatic habitat for native species. Vegetation management would include even-aged regeneration harvests on approximately 2,290 acres, creating 22 openings over 40 acres ranging from 40 to 291 acres. Prescribed fire would be used across approximately 925 acres to reduce fuels (logs, branches, and brush) that contribute to fire intensity and prepare for reforestation. Road work would provide access to units, help reduce sediment to streams, and improve aquatic and hydrological function. Contracts associated with commercial timber harvest would contribute jobs and other economic benefits to communities.
