Public Comment Period Open Now for Broadband Initial Proposal The Idaho Broadband Advisory Board and Idaho Office of Broadband have opened a public comment period on the State’s Broadband Equity, Access and Deployment (BEAD) program, Initial Proposal (Volumes I and II) for the National Telecommunications and Information Administration (NTIA). The State has been working to identify Idaho’s internet needs, challenges, and opportunities to develop internet expansion plans. The work is reflected in the State’s draft BEAD Initial Proposal. Volume I establishes the groundwork for the State’s strategy to bring internet to all and identify project areas and locations of interest. Volume II details the plans for distributing deployment funding, workforce and economic development initiatives, tribal coordination and more. The entire BEAD Initial Proposal is now posted online for review and comment at LinkUp.Idaho.gov. ORDINANCE NO. 2023-244 AN ORDINANCE OF THE CITY OF PINEHURST, A POLITICAL SUBDIVISION OF THE STATE OF IDAHO, AMENDING THE VIOLATION SECTION OF PINEHURST CITY ORDINANCE #2017-220, REPEALING CONFLICTING ORDINANCES, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Pinehurst desires to update the penalties for ordinance violations to reflect best practices in code enforcement; and WHEREAS, setting penalties by resolution allows for greater flexibility in modifying the penalties to better accommodate the general welfare of its citizens and good zoning practices; and WHEREAS, code enforcement strategies and resources used by the city of Pinehurst have substantially changed since the passing of this ordinance. THEREFORE, BE IT ORDAINED by the Mayor and City Council of the city of Pinehurst, Shoshone County, Idaho, that the following ordinance of the City is hereby amended as follows: Section 1: That Title 11, Chapter 15, Section 2 of Pinehurst City Ordinance #2017-220 is hereby repealed. Section 2: That Title 11, Chapter 15, Section 2 of Pinehurst City Ordinance #2017-220 is replaced in entirety and hereby reads as follows: 11-15-2: VIOLATIONS.  A. Criminal Enforcement: 1. Every person who fails to comply with the provisions of this ordinance has committed a violation.  2. Enforcement of this title against a property in violation of this ordinance may be sought against either the property owner, any occupant or both.  3. Penalties for violation of the provisions of this ordinance shall be set by Resolution of the Mayor and City Council of the City of Pinehurst.   4. Every violation shall be deemed a separate offense for each and every day or portion thereof which any violation of the provisions of this ordinance is committed, continued, or permitted.   B. Civil Enforcement: 1. In addition to taking whatever criminal action is deemed necessary, the City may take steps to civilly enjoin any violation of this ordinance or may initiate any civil legal action available in a court of competent jurisdiction.   2. In the event the City prevails in a civil enforcement action, the violator shall be responsible for all costs including a reasonable sum for attorney’s fees and any costs incurred in abating the violation.   3. Nothing herein contained shall prevent the City Council or other public official from taking such legal action as may be necessary to restrain or prevent any violation of this ordinance or the Idaho Code.   Section 3: This ordinance is hereby declared to be severable. Should any portion of this ordinance be declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purpose(s) of the ordinance before the declaration of partial invalidity. Section 4: All other provisions of the current Pinehurst City Ordinance #2017-220 shall remain in full force and effect to the extent they do not conflict with this amendment.   Section 5: All provisions of the current ordinances of the city of Pinehurst which conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict.
