NOTICE OF INTENT TO SUBMIT STATE PLAN AMENDMENTS AND SOLICITATION OF PUBLIC INPUT Pursuant to 42 C.F.R. § 440.345 EPSDT and other required benefits, 42 C.F.R. § 440.386 Public notice, 42 C.F.R. § 447.204 Medicaid provider participation and public process to inform access to care, and 42 C.F.R. § 447.205 Public notice of changes in Statewide methods and standards for setting payment rates, the Idaho Department of Health and Welfare Division of Medicaid (Department) provides public notice of relating to submission of State Plan Amendments (SPAs) to the Centers for Medicare and Medicaid Services (CMS). PROPOSED CHANGES Idaho Medicaid is submitting, and intends to submit, two (2) State Plan Amendments (SPAs) to the Centers for Medicare and Medicaid Services (CMS) to address certain telehealth-related public health emergency (PHE) flexibilities for the state’s three (3) 1915(i) State Plan authorities. On April 30, 2021, CMS approved SPA ID-20-0014 COVID19 Disaster SPA 1915i Adult DD. On May 28, 2021, CMS approved SPA ID-21-0008 COVID19 Disaster SPA 1915i Children’s DD. These two authorities are active during the federal PHE. One set of secured flexibilities involves the use of telehealth options for certain services, as well as for evaluations, assessments, and person-centered service planning. Another set of flexibilities involves the use of electronic signatures. The state received new direction from CMS on March 8, 2023 that state plan amendments would be required to continue these flexibilities after the end of the federal PHE on May 11, 2023. • In line with this guidance, the state is submitting a COVID19 Disaster SPA for the 1915i Serious Emotional Disturbance (SED) State Plan authority, to establish appropriate federal authority for the period during the PHE (SPA ID-23-0018). • The state will also be submitting a State Plan Amendment (SPA ID-23-0019) to continue these flexibilities until May 11, 2024, for all three (3) 1915i authorities. The Department is submitting SPA ID-23-0018 to CMS with a requested effective date of March 13, 2020.  The Department will be submitting SPA ID-23-0019 to CMS with a requested effective date of May 11, 2023, and the flexibilities will last through May 11, 2024.
