AMENDING SECTION TITLES; AMENDING RCC SECTION 7-7-2 BY SPLITTING THE RIGHT OF WAY ENCROACHMENT PERMIT INTO A MAJOR AND MINOR PERMIT, INCLUDING TEMPORARILY CLOSING ROADS AND OBSTRUCTIONS AND THEIR DEFINITIONS, AND EXCLUDING ERECTING SIGNS FROM REQUIRING A PERMIT UNDER THIS CHAPTER; AMENDING RCC 7-7-3 WITH A NEW TITLE CALLED MAJOR AND MINOR RIGHT-OF-WAY ENCROACHMENT PERMITS, PROVIDING FOR A MAJOR AND MINOR PERMIT FORM AND REQUIRED SUBMITTALS, DELETING THE REQUIREMENT FOR PROVIDING TWO (2) COPIES OF PLANS, AND PROVIDING FOR REVIEW AND APPROVAL, MINIMUM REQUIREMENTS, INSPECTION, PUBLIC WORKS CONTRACTOR’S LICENSE, FEES, WINTER MONTHS, EMERGENCIES, STATE OR HIGHWAY DISTRICT JURISDICTION, AND SEWER CONNECTIONS; AMENDING RCC SECTION 7-7-4 TO CLARIFY WHO IS EXEMPTED AND ADD THAT ROUTINE MAINTENANCE IS EXEMPTED AS WELL AS PUBLIC ENTITES THAT HAVE PRIOR APPROVAL FOR THE EXEMPTION; AMENDING RCC SECTION 7-7-5 TO PROVIDE FOR INSURANCE AND BOND REQUIREMENTS FOR THE PERMITS; AMENDING RCC SECTION 7-7-6 FOR THE ISSUANCE OF PERMITS AND INCLUDING THAT PERMITS MUST BE OBTAINED BY THE PERSON DOING THE WORK AND ARE VALID FOR 180 CALENDAR DAYS; AMENDING RCC SECTION 7-7-7 FOR UTILITY COMPANIES PROVIDING THAT UTILITY COMPANIES ARE RESPONSIBLE FOR OBTAINING ALL PERMITS AND INCLUDING THE REQUIRED SUBMITTALS FOR SUBCONTRACTORS; ADDING RCC SECTION 7-7-8 FOR NOTICE REQUIREMENTS; ADDING RCC SECTION 7-7-9 PROVIDING FOR FAILURE TO COMPLY WITH OTHER LAWS AND REGULATIONS; ADDING RCC SECTION 7-7-10 PROVIDING FOR AN APPEAL PROCESS; ADDING RCC SECTION 7-7-11 PROVIDING THAT ILLEGAL WORK IN THE PUBLIC RIGHT-OF-WAY IS SUBJECT TO THE CITY’S GENERAL PENALTY PROCEDURES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE.
