Industrial Loop, Coeur d’Alene, ID  83815, at 10:00 a.m. local time, on Tuesday, June 20, 2023, for an estimated 6,120 MBF of timber marked or otherwise designated for cutting. In addition, there is an unestimated volume of forest products that may be removed at the option of the purchaser. A hotel-motel room occupancy charge tax is hereby imposed at the rate of five and one-half percent (5.5%) on room occupancy charge (30 days or less) for each hotel- motel room rented or leased within the city limits. Said room occupancy tax shall apply to, be computed on and collected on, all room occupancy charge, including all credit, installment, conditional or similar rental or lease fees, at the time the fee for rental is charged. Said room occupancy tax shall be collected by the owner of said property or the owner’s authorized agent from the renter or lessee. 1-17-3: DURATION OF TAXES:  The local option non-property tax authorized and collected under this chapter is hereby imposed for a period of ten (10) years from the effective date hereof.  1-17-4: PURPOSES FOR WHICH THE REVENUES SHALL BE USED:  The non-property tax revenue derived from and collected under this chapter shall be used for the following purposes:   A. Maintenance of City street system and related projects;  B. Matching grant funds; C. Any revenues received in excess of the budget amount will be placed in a designated property relief fund D. Actual cost of collecting and administering the tax (to be retained by the City) E. City parks  F. Maintenance of public rights-of-way 1-17-8: METHOD FOR PAYMENT AND REPORTING  C. Any permittee who is required to collect and pay over to the city any tax imposed by this chapter and fails or refuses to pay the same when due in accordance with this chapter, shall be liable for a penalty on the tax not paid. Said penalty shall be equal to ten percent (10%) of the tax not paid, or a minimum of ten dollars ($10.00) (whichever is greater). The city treasurer shall assess and collect said fee at the time any delinquent tax payment is tendered. The permittee may appeal this determination pursuant to section 1-17-11 of this chapter. If no appeal is timely made as herein provided, said penalty determination shall be final. SECTION 2. SEVERABILITY CLAUSE. If any paragraph, part, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid for any reason by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.  SECTION 3. PUBLICATION. This Ordinance shall be published once in the official newspaper of the City.  SECTION 4. REPEALER CLAUSE. All City code sections, ordinances or resolutions or parts thereof, which are in conflict herewith are hereby repealed.  SECTION 5. EFFECTIVE DATE. NOTICE OF RESOLUTION ADOPTION The Board of Commissioners of Kootenai County, Idaho, hereby gives notice of the adoption of Resolution 2023-42, Second Amended Kootenai County Waterways Restricted Zone Designation. The full text of the Resolution is as follows: Resolution 2023-42 SECOND AMENDED Kootenai County Waterways Restricted Zone Designation Amending and Superseding, in part, Resolution 2021-63 WHEREAS, the Kootenai County Board of Commissioners (hereinafter referred to as “the Board”), pursuant to Idaho Code §31-807, is authorized to preserve, take care of, manage, and control county property; and WHEREAS, the Board is empowered to enact ordinances necessary or proper to provide for the safety, promote the health and prosperity, improve the morals, peace and good order, comfort and convenience of the court and its inhabitants pursuant to Idaho Constitution Article XII, section 2 and Idaho Code §§31-714 and 67-7031(3); and WHEREAS, the Kootenai County Parks and Waterways Ordinance provides for the codification of resolutions adopted by the Board of Commissioners as an appendix to the ordinance, Kootenai County Code, Section 6-2-21; and WHEREAS, the Kootenai County Sheriff previously recommended certain amendments to the Kootenai County Code, establishing inter alia a no-excessive wake zone along the Spokane River and on Fernan and Lower Twin Lakes between the 100 foot no-wake zone and 150-feet from shoreline or any dock, pier, or other structure. The Board found that the recommended restricted zone was appropriate and adopted the same via Resolution 2020-38 on May 21, 2020; and WHEREAS, the Board subsequently determined that the safety of persons and property counseled against limiting the no-excessive wake zone to only those portions of the Spokane River and on Fernan and Lower Twin Lakes between the 100 foot no-wake zone and 150-feet from shoreline or any dock, pier, or other structure. The Board adopted a no excessive wake zone applicable to the entirety of the Spokane River, Fernan Lake, and Lower Twin Lake via Resolution 2021-63 on July 6, 2021; and WHEREAS, Idaho Code §67-7016 prohibits the grossly negligent operation of a vessel without due caution and circumspection, and in a manner to endanger or likely to endanger any person or property; and Idaho Code §67-7017 prohibits the careless and heedless operation of a vessel so as to be indifferent to persons or property; and  WHEREAS, pursuant to Idaho Code §67-7028, the Kootenai County Sheriff has a statutory obligation to enforce violations of Idaho Code §§67-7016 and 7017, and the Kootenai County Sheriff has represented to the Board his intention to so enforce violations of Idaho Code §§67-7016 and 7017; and  WHEREAS, the Kootenai County Sheriff, the Director of the Kootenai County Parks and Waterways Department, and the Kootenai County Waterways Advisory Board have recommended rescinding the no-excessive wake zone on the Spokane River; and WHEREAS, the Board finds the no-excessive wake zone applicable to the entirety of the Spokane River shall be rescinded.  WHEREAS, the Kootenai County Sheriff, the Director of the Kootenai County Parks and Waterways Department, and the Kootenai County Waterways Advisory Board have recommended the Board adopt a no towing zone on the Spokane River between the 100-foot no-wake zone and 150-feet from shoreline or any dock, pier, or other structure; and WHEREAS, the Board has determined and finds that the Spokane River shall be designated a no waterskiing zone, as defined in Kootenai County Code 6.2.106(A)(7), prohibiting motor-driven watercraft from towing a water-skier, a tube, a wakeboard, a knee board, or any other type of appliance, between the 100-foot no-wake zone and 150-feet from shoreline or any dock, pier, or other structure on the Spokane River  NOW THEREFORE, IT IS HEREBY RESOLVED, that the no-excessive wake zone on the Spokane River identified hereinabove shall be rescinded; that a no waterskiing zone be established and enforced between the 100 foot no-wake zone and 150-feet from shoreline or any dock, pier, or other structure on the Spokane River; and that the instant Resolution be codified as an appendix to the Kootenai County Parks and Waterways Ordinance pursuant to Section 6-2-21, and supersede those portions of Resolution 2021-63 establishing a no-excessive wake zone on the Spokane River.   Upon a motion to adopt the text of the foregoing Resolution made by Commissioner Duncan, seconded by Commissioner Brooks, the following vote was recorded: Commissioner Brooks: Aye Commissioner Mattare: Nay Chair Duncan: Aye Upon said roll call, the text of the foregoing was duly enacted as a Resolution of the Board of Commissioners of Kootenai County, Idaho on the 5th day of April, 2023.   KOOTENAI COUNTY BOARD OF COMMISSIONERS ATTEST: JENNIFER LOCKE, CLERK /s/Leslie Duncan, Chair By: /s/Teri Johnston, Deputy Clerk /s/Bruce Mattare, Commissioner /s/Bill Brooks, Commissioner This Resolution shall go in effect thirty (30) days after initial publication hereof. The full text of Resolution 2023-42 is available at the Kootenai County Commissioners Office, 451 Government Way, Coeur d’ Alene, Idaho 83814, weekdays from 8:00 a.m. to 5:00 p.m. KOOTENAI COUNTY BOARD OF COMMISSIONERS ATTEST: JENNIFER LOCKE, CLERK /s/Leslie Duncan, Chair By:/s/Teri Johnston, Deputy Clerk Legal#10783 AD#10246 June 13, 2023 _________________________
