STATE TIMBER SALE CR225083, BEAR BASIN A public oral auction will be conducted at the Idaho Department of Lands office, 80 Hilltop Overpass Road, Kingston, ID 83839, at 9:00 a.m. local time, on Thursday, December 21, 2023 for an estimated 6,095 MBF of timber marked or otherwise designated for cutting. In addition, there is an unestimated volume of forest products that may be removed at the option of the purchaser. ORDINANCE NO. 405 VACATION OF A PORTION OF IDAHO AVENUE AN ORDINANCE OF THE CITY OF MULLAN, A MUNICIPAL CORPORATION OF IDAHO, PROVIDING FOR THE VACATION OF A PORTION OF THE PLATTED RIGHT-OF-WAY OF IDAHO AVENUE, DUBEY’S ADDITION, WITHIN THE CITY OF MULLAN.  WHEREAS, Idaho Code §50-311 empowers the cities of this state to vacate or discontinue any public street, road, or right of way, whenever deemed expedient for the public good.   WHEREAS, on the 15th day of November, 2023 the City Council received a petition to vacate a portion of Idaho Avenue in Dubey’s Addition, within the City of Mullan.   WHEREAS, following receipt of the petition to vacate, the City of Mullan effectuated publication of notice of a public hearing on the proposed vacation, as well as mailing of said notice to those so entitled, as required by Idaho Code §50-1306A.   WHEREAS, on the 5th day of December, 2023 the City Council conducted a public hearing, duly noticed and agendized, on the matter of vacation of a portion of Idaho Avenue in Dubey’s Addition, within the City of Mullan.   WHEREAS, at the public hearing, evidence and testimony was received by the City Council which indicated that the portion of right of way requested for vacation contains a structural encroachment that is not easily movable, that said portion has not been utilized for any benefit of the public, and that vacation of the petitioned portion of right of way was otherwise in the public’s interest.   NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MULLAN AS FOLLOWS: SECTION 1: That a portion of Idaho Avenue of Dubey’s Addition to the Village of Mullan attached hereto titled Exhibit A, hereby be vacated.
