AMENDMENT OF ZONING MAP. The following change in zoning is hereby APPROVED: Case No. ORA22-0004, a request by Cougar Gulch Property Owners for a Zone Change from Agricultural Suburban to Rural of each of the parcels depicted as Rural on the map attached as Exhibit “A” hereto and incorporated by reference herein. Those parcels depicted as Agricultural Suburban on the map attached as Exhibit “A” hereto shall remain in the Agricultural Suburban zone. SECTION 2. REPEAL OF CONFLICTING PROVISIONS. Any previous zoning classification for lands depicted as Rural on the map attached as Exhibit “A” hereto shall be, and is hereby repealed. SECTION 3. AMENDMENT TO LAND USE AND DEVELOPMENT CODE TEXT. Section 8.2.203, Kootenai County Code, shall be, and is hereby amended as follows: 8.2.203: PARCEL LOT SIZE, DENSITY AND SITE AREA: A. The minimum parcel lot size in the Rural zone, except in conservation subdivisions and except as provided in subsection (B) of this section, shall be five (5.00) acres. B. Parcels of less than five (5.00) acres which were zoned Agricultural Suburban prior to December 8, 2022 and were rezoned to Rural as of that date shall be regarded as conforming parcels for purposes of this title. Uses permitted of right on such parcels shall be based on parcel size as set forth in section 8.2.304, 8.2.305, or 8.2.306 of this chapter. SECTION 4. PROVIDING AN EFFECTIVE DATE. This Ordinance shall take effect and be in full force upon its passage, approval, and publication in one (1) issue of the Coeur d’Alene Press.
