Swayne files suit against NIC

North Idaho College President Nick Swayne has filed a lawsuit against the college alleging that the decision by the trustees and college attorney Art Macomber to place him on administrative leave violates his employment agreement.

The lawsuit, filed by attorney Tara Malek with the Coeur d'Alene firm of Smith+Malek, says that Swayne’s employment contract does not contain a provision allowing him to be placed on administrative leave, and because Swayne has not given notice of resignation, he should be allowed to return to his employment.

The court filing seeks an award of attorney’s fees and costs and “such other and further relief as the court determines is just and proper under the circumstances.”
