SUMMARY OF ORDINANCE NO. 1 An Ordinance creating the Kidd Island/Harbor View Joint Sewer LID Board Local Improvement District No. 1; describing and setting forth the boundaries of said local improvement district; providing for the improvements to be made therein; authorizing the advertising for bids for said work as provided by law; providing for the payment of costs and expenses of said improvements to be assessed against the property within the district benefited thereby and the method of assessment; providing for the issuance of local improvement district bonds and/or warrants; providing for the publication of a summary of this ordinance; and providing for other matters properly relating thereto A summary of the principal provisions of Ordinance No. 1 of Kidd Island/Harbor View Joint Sewer LID Board (the "Joint Board"), adopted on April 25, 2022, is as follows: Section 1. Finds and declares that formation of Kidd Island/Harbor View Joint Sewer LID Board Local Improvement District No. 1 (the "LID No. 1") is in the best interest of the property affected and the Joint Board; there is a reasonable probability that the obligations of LID No. 1 will be paid; the value of the property subject to assessment within LID No. 1, including the proposed Improvements (defined below), is sufficient to provide for the repayment of the obligations of the proposed LID No. 1 and exceeds the sum of the estimated costs to be assessed against the property; and that a public hearing to consider all protests to the formation of LID No. 1 was held on April 18, 2022, and the Board has reviewed all testimony at the hearing and all written protests presented to the District. Section 2. Creates the Kidd Island/Harbor View Joint Sewer LID Board Local Improvement District No. 1, the boundaries of which are set forth in Exhibit A, attached hereto. Section 3. Describes the improvements to be made within LID No. 1 as follows (the "Improvements"): A. General descriptions of the Improvements (as further described in Kidd Island Bay Lots Sewer District, Kootenai County, Idaho, Facility Plan for Wastewater Reuse Permit, No. MU-86-04, September 28, 2021) are as follows: 1. The design, acquisition, construction and installation of improvements to the existing treatment and collection system including but not limited to: (i) Treatment system upgrades consisting of converting hay fields to forest for irrigation, replacing the lagoon liners, expanding the lagoon storage capacity, increasing the capacity of the irrigation pumping system, upgrading the electrical service including an extension of 3-phase power to the site, upgrading the aeration system, adding additional chlorine contact piping, adding new irrigation force mains, developing existing property that is not currently developed with irrigation, and expanding spray and drip irrigation by acquiring 25-acres of forest land, with 13-acres developed for irrigation and the remainder accounting for buffer zones; and (ii) Collection system improvements including septic tank and cleanout rehabilitation along Westway Drive beachfront, lift station and valve vault rehabilitation, a new flow meter for KIB, and an annual septic tank inspection and rehabilitation program, together with all related appurtenances; and 2. Acquisition of easements and/or rights-of-way, as necessary; and B. Costs of construction will include, but are not limited to, engineering, legal, accounting, costs of bond issuance, costs of interim financing, costs of financial advice, the funding of a guarantee fund or reserve account to secure payment of the financing, and other costs incidental thereto. Section 4. Defines the costs and expenses to be included in the price of the Improvements. Section 5. The total estimated cost of the Improvements is approximately $6,880,000, all of which shall be borne by and assessed against the properties specially benefited by such Improvements according to a benefits derived method as set forth in Section 50-1707, Idaho Code. Properties within the KIDD District boundary shall be assessed for the costs of Improvements related to the treatment and collection system, while properties within the HV District will be assessed only for the costs of Improvements related to the treatment system. Upon final confirmation of the assessment roll under Idaho Code Section 50-1715, the District anticipates it will permit unpaid assessments to be payable in installments. Section 6. Provides for the issuance of warrants, if necessary, for the immediate payment of the costs of the Improvements, and provides for the issuance of bonds upon the final assessment on the benefited property. Section 7. Incorporates all matters and things done in regard to the creation of LID No. 1. Section 8. States that the Ordinance shall take effect after its passage, approval, and publication of a summary thereof. Exhibit "A": Provides a list of oral and written protests.
