Summary of Bond Ordinance, passed July 19, 2021 Ordinance Authorizing the Issuance and Providing for the Sale of General Obligation Bonds, Series 2021 of Kootenai County Fire and Rescue, Kootenai County, State of Idaho, Authorizing the Manner of Sale of the Bonds, Delegating Authority to Approve the Terms, Provisions and Sale of the Bonds, and Providing for Related Matters. Section 101 (Definitions) defines certain capitalized terms used in the Ordinance. Section 102 (Authority for Ordinance) provides the Ordinance is adopted pursuant to the law. Section 103 (Effective Date) provides that the Ordinance shall take effect from and after its passage and publication of this summary as required by law Section 201 (Authorization of Bonds, Principal Amount, Designation and Series) provides that the Ordinance is adopted pursuant to the provisions of Sections 50-1019 and 50-1026, and the Municipal Bond Law of the State of Idaho, being Idaho Code, Title 57, Chapters 2, 5 and 9 (collectively, the "Act") to authorize its General Obligation Bonds, Series 2021 (the "2021 Bonds") in the principal amount of $14,900,000. Section 202 (Purposes) sets forth that the 2021 Bonds shall finance the project authorized by the District's May 18, 2021, successful general obligation bond election together with costs of issuance. Section 215 (Further Authority) authorizes the officers of the District to do or perform all acts and execute all documents to provide for the issuance, sale and delivery of the 2021 Bonds. Section 301 (Transfer of Bonds) provides transfer provisions related to the 2021 Bonds. Section 302 (Exchange of Bonds) provides exchange provisions related to the 2021 Bonds. Section 303 (Bond Registration Books) provides that the Ordinance shall constitute a system of registration for purposes of chapter 9 of Title 57, Idaho Code. Section 304 (List of Bondholders) provides that the Bond Registrar shall maintain a list of owners of the 2021 Bonds. Section 305 (Duties of Bond Registrar) provides the duties of the Bond Registrar with respect to the 2021 Bonds. Section 401 (Book-Entry Systems, Limited Obligations) provides for the registration of the Bonds in the name of Cede & Co. Section 402 (Representation Letter) provides for the execution of a Registration Letter to effectuate the book-entry-only registration letter. Section 403 (Transfers Outside Book-Entry System) provides for transfers outside the book-entry system. Section 404 (Payments to Cede & Co.) provides that so long as the Bond is registered in the name of Cede & Co., all payments shall be made as provided in the Registration Letter. Section 501 (Levy of Taxes, Pledge of Tax Receipts) sets forth the District's covenants to pay the debt service of the Bonds when due and shall levy general taxes upon all taxable property of the District sufficient to pay such debt service. The District pledges the full faith and credit of all taxable property in the District to the Bonds. Section 502 (Tax Receipts to Constitute Special Revenues) provides tax receipts are "special revenues" as defined under 11 U.S.C. Section 902(2). Section 503 (Bonds in Registered Form) provides that the 2021 Bonds shall remain in fully registered form. Section 504 (Arbitrage Covenant; Covenant to Maintain Tax Exemption) authorizes the District's officials to execute Tax Certificates to establish the 2021 Bonds are not arbitrage bonds pursuant to Section 148 of the Code. The District covenants that it will not take action to cause interest on the 2021 Bonds to affect the tax-exempt status thereof and will not take action to cause the Bonds to be "private activity bonds" within the meaning of Section 171 of the Code. Section 505 (Investment of Funds) provides that moneys held in any fund or account shall be invested and reinvested in Investment Securities pursuant to written direction of the District. Section 506 (No Waiver of Limitation Provisions) provides the covenant of the District that the District will not waive the time limitation provisions of Section 34-2001A, Idaho Code, with respect to the Bond Election. Section 601 (Form of Bonds) provides that the form of the Bonds shall be in substantially the form as Exhibit A to the Ordinance. Section 701 (Ratification) ratifies, confirms and approves all proceedings, resolutions, and ordinances in connection with the sale and issuance of the Bonds. Section 702 (Severability) provides that other covenants and agreements in the Ordinance are not affected if one is made invalid. Section 703 (Conflict) repeals all resolutions, orders and regulations or parts thereof conflicting with the Ordinance. NOTICE OF ADVERTISEMENT PRE-QUALIFICATIONS FOR Ponderosa Lift Station Replacement FOR THE CITY OF POST FALLS The City of Post Falls is seeking to pre-qualify general contractors for the Ponderosa Lift Station Replacement in the City of Post Falls, pursuant to Idaho Code 67-2805, "Procurement of Public Works Construction". Pre-qualification applications will be received at the office of the City Clerk (Shannon Howard), City of Post Falls, located at City Hall, 408 N. Spokane Street, Post Falls, Idaho 83854 until 10:00 a.m. local time, Thursday, August 12th, 2021. Work associated with the proposed project is generally described as follows: Complete replacement of the existing lift station including wet well, pumps, valve vault, electrical control, generator, and associated system components. The proposed lift station includes a new submersible triplex lift station capable of 1,800 gallons per minute, 55,000 gallons of emergency storage constructed of a buried cast-in-place concrete structure that is integral to the pump wet well, bypass pumping provisions, re-routing of 225 LF gravity sewer mains, 374 LF of force main, 260 S.F. control building, decommission existing lift station, landscaping and irrigation, and utility coordination. Other site improvements include construction of approximately 2,150 S.F. of new paved entrance road.
