CITY OF POST FALLS ORDINANCE NO. 1403 AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR FISCAL YEAR BEGINNING OCTOBER 1, 2020, APPROPRAITING THE SUM OF $96,587,162 TO DEFRAY THE EXPENCSES AND LIABILITIES OF THE CITY OF POST FALLS FOR SAID FISCAL YEAR AND ESTABLISHING KINDS AND LEVELS FOR ESTABLISHED POSITIONS, AUTHORIZING A LEVY OF A SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SECIFYING THE OBJECTS AND PURPOSES FOR WHICH SAID APPROPRIATIONS ARE MADE. BE IT ORDAINED by the Mayor and City Council of the City of Post Falls, Kootenai County, Idaho. Section 1. That the sum of $96,587,162 is, and the same hereby is appropriated to defray the necessary expenses and liabilities of the City of Post Falls, Kootenai County, Idaho for the fiscal year beginning October 1, 2020. Appropriations are made at the fund level with additional detail shown for illustrative purposes only. Section 2. ORDINANCE NO. 551 EMERGENCY ORDINANCE REGARDING WAIVER OF SPECIAL NOTICE PERMIT REQUIREMENT FOR USE OF CONDON PROPERTY FOR DOCK AND DEBRIS REMOVAL OPERATION AN EMERGENCY ORDINANCE OF KOOTENAI COUNTY, IDAHO, A POLITICAL SUBDIVISION OF THE STATE OF IDAHO, RELATING TO LAND USE REGULATION; WAIVING THE NORMAL SPECIAL NOTICE PERMIT REQUIREMENT FOR USE OF PROPERTY OWNED BY JOHN AND GAYLA CONDON FOR THE REMOVAL OF A DOCK AND DEBRIS WHICH THREATEN THE WATER QUALITY OF COEUR D'ALENE LAKE; PROVIDING FOR SEVERABILITY; PROVIDING FOR NON-WAIVER OF ACTIONS REGARDING VIOLATIONS OCCURRING WHILE PRIOR ORDINANCES WERE IN EFFECT; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A SUNSET DATE. WHEREAS, in July of 2020, the Idaho Department of Lands (IDL), with support from the Idaho Department of Environmental Qulaity (DEQ) and the Idaho Department of Fish and Game (IDFG), informed Kootenai County Community Development of a failing dock located on and/or riparian to real property owned by Alan J. Golub, Parcel No. 49N03W-03-5000 (AIN 148865); and WHEREAS, the aforesaid dock had been producing debris which was floating on Coeur d'Alene Lake; and WHEREAS, a portion of real property owned by the John and Gaila Condon Living Trust, Parcel No. 49N02W-06-7000 (AIN 111552) ("the Condon property"), is located within the Commercial zone near the location of the aforesaid dock, and as such, is ideal for North Idaho Maritime, a business owned by Mr. Condon, to accomplish the removal of the aforesaid dock and associated debris; and WHEREAS, because the Condon property fronts State Highway 97, a special notice permit is required for any use to be established on that property under section 8.2.607, Kootenai County Code; and WHEREAS, IDL has indicated that immediate cleanup of the aforesaid dock and debris is necessary to mitigate the threat to the water quality of Coeur d'Alene Lake, particularly in the vicinity of Moscow Bay; and WHEREAS, no special notice permit has yet been issued or applied for with respect to the Condon property; and WHEREAS, nevertheless, the Board concurs with the assessment of IDL, DEQ and IDFG with respect to the threat to the water quality of Coeur d'Alene Lake that the aforesaid dock and associated debris pose; and WHEREAS, the Board desires the immediate removal of the aforesaid dock and as much of the associated debris as practicable from Coeur d'Alene Lake; and WHEREAS, a requirement to use another location on Coeur d'Alene Lake or the Spokane River to conduct dock removal operations would be likely to create additional harm to the water quality of Coeur d'Alene Lake; and WHEREAS, based on the above recitals, the Board hereby finds that the aforementioned conditions do constitute an imminent peril to the public health, safety, and/or welfare of Kootenai County, and that these conditions do justify the enactment of this Ordinance as an emergency ordinance pursuant to section 67-6523, Idaho Code; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF KOOTENAI COUNTY, IDAHO: SECTION 1. The requirement to obtain a special notice permit set forth in section 8.2.607, Kootenai County Code, is hereby WAIVED with respect to the use of the portion of real property owned by the John and Gaila Condon Living Trust, Parcel No. 49N02W-06-7000 (AIN 111552), located within the Commercial zone for the removal of a failed dock on and/or riparian to real property owned by Alan J. Golub, Parcel No. 49N03W-03-5000 (AIN 148865), and debris from the aforesaid dock floating on Coeur d'Alene Lake. SECTION 2. The waiver granted in Section 1 hereof shall be for the purposes set forth in that section only, and for no other purpose. SECTION 3. If any section, subsection, paragraph, sentence, clause, or phrase of this ordinance should be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this ordinance which shall remain in full force and effect; and to this end the provisions, of this Ordinance are hereby declared to be severable. SECTION 4. Neither the adoption of this Ordinance nor the repeal of any ordinance shall, in any manner, affect the prosecution for violation of such ordinance committed prior to the effective date of this Ordinance or be construed as a waiver of any license or penalty due under any such ordinance or in any manner affect the validity of any action heretofore taken by the Kootenai County Board of Commissioners or the validity of any such action to be taken upon matters pending before the Kootenai County Board of Commissioners on the effective date of this Ordinance. SECTION 5. This Ordinance shall take effect and be in full force retroactive to August 1, 2020. SECTION 6. This Ordinance shall be null and void, and of no further force or effect, upon the earlier of the completion of the work authorized in Section 1 hereof or December 31, 2020. The intent of the text amendments is to respond to identified deficiencies and/or conflicts in code, address common practices and/or to provide for clarity and ease of use as requested by the Rathdrum City Council. Provide for required guest parking, access and circulation standards for easy navigation, locating parking in relation to dwellings, requiring pedestrian and bicycle pathways and other standards for multi-family and institutional developments, 9. Provide for clarification of landscape standards and irrigation for multi-family and institutional developments, 10. Clarify accessory structures, utilities and fencing to ensure consistent design and compatibility with development, location and screening for multi-family and institutional developments, P11. rovide additional standards for lighting to address safety, provide a maximum height of light poles, minimize light trespass for multi-family and institutional developments, and C12. larify site plan review requirements which include multi-family and institutional developments with three (3) or more dwelling units. In summary the purpose and intent of the proposed changes will: 1. Ensure that multi-family projects are designed to be compatible with surrounding neighborhoods and land uses, 2. Encourage multi-family projects that residents can take pride in and have a sense of ownership in their neighborhood, 3. Enhance the interface of multi-family development in relation to surrounding uses with attention to building placement, massing and orientation, landscaping treatment and open space areas, and 4. Ensure that multi-family projects incorporate amenities that enrich the lives of residents, address privacy, solar access, lighting and aesthetics.
