NOTICE OF PUBLIC HEARING APPEAL of a SPECIAL USE PERMIT REQUEST NOTICE IS HEREBY GIVEN that the City of Hayden City Council will conduct a public hearing on Tuesday, June 23, 2020 at 5:00 p.m. at Hayden City Hall Council Chambers, 8930 N. Government Way, Idaho, to consider Case No. PZE-20-0030 an Appeal of the Written Decision of the Planning and Zoning Commission for PZE-19-0341. The applicant, Peter Smith, Smith + Malek, representing the Owner, McCarthy Capital, Inc. has appealed the Written Decision of the Planning and Zoning Commission for the McCarthy Capital Special Use Permit for 12 lot of a 15 lot minor subdivision in the Residential (R-1) zone to be able to develop as two-family dwellings (duplexes). The minor subdivision to be known as Wyoming Estates 1st Addition is located south of East Wyoming Avenue and approximately 825 feet east of North Government Way, more commonly known as 300 E Wyoming Avenue and is approximately 4.495 acres. The subject site is currently the site of a single family residence with accessory structures. Specifically, the appeal is with respect to condition #10 of the Written Decision, which limits the number and location of the allowed lots, thereby granting in part and denying in part the request for two-family dwellings on 12 lots and limiting the approval to seven lots of those proposed in the subdivision. Condition #10 (page 7 of 8) states the following: "The approval for two-family dwellings shall be for the lots identified in the preliminary plat of the Wyoming Estates 1st Addition as Block 1 Lots 1-7. The remainder of the Wyoming Estates 1st Addition has not been approved for two-family dwellings as part of his special use permit."
