Combined Public Notice Finding of No Significant impact on the Environment and Notice to Intent to Request for Release of Funds City of Spirit Lake (Name of Grantee) 6042 W Maine Street, Spirit Lake, ID 83869 (Street, City, Zip Code) 208-623-2131 (Telephone No.) These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City. Request for the Release of Funds On or about January 18, 2021 the City of Spirit Lake will submit a request to the Idaho Department of Commerce, State of Idaho, administering agency for the release of Idaho Community Development Block Grant (ICDBG) funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake the following project: Project Title: Spirit Lake New Water Reservoir #3 Purpose or Nature of the Project: The project includes the construction of a 500,000-gallon water storage reservoir next to the newly constructed Well #5 on the City's current utility lot. The 100 feet high by 30 feet in diameter water storage tank will be constructed to meet the existing and future needs of the City for fire flow and to protect property and lives of citizens. Project components include a new reservoir mixer, yard piping, existing system interconnection, overflow system connection, foundation excavation and backfill, reservoir foundation, electrical and control installation, and site rehabilitation. Location of Project: Spirit Lake City, Kootenai County, Idaho Estimated Cost of Project: $1,612,950 Finding of No Significant Impact The City has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Spirit Lake City Hall, 6042 W Maine Street, Spirit Lake, Kootenai County where the ERR may be examined or copied weekdays 9:00 A.M. to 4:00 P.M., Monday through Friday. Public Comments Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comment to the City for receiving and responding to comments. All comments received before January 18, 2021 will be considered by the City prior to authorizing submission of a request for release of funds. Comment should specify which Notice they are addressing. Release of Funds The City certifies to the Idaho Department of Commerce that the Honorable Renee Eastman, in her official capacity as Mayor consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental review process and that these responsibilities have been satisfied. The Idaho Department of Commerce's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows for the City to use ICDBG funds. Objections to State Release of Funds The Idaho Department of Commerce will accept objections to its release of funds and the City certification for a period of sixteen (16) days following the anticipated submission date or its receipt of the request (whichever is later) only if they are on one of the following bases: a. The certification was not executed by the certifying officer. b. The City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58. c. The City has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of the release of funds by the Idaho Department of Commerce. d. Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
