NOTICE OF PUBLIC HEARING AMENDMENTS TO CITY CODE NOTICE IS HEREBY GIVEN that the City of Hayden Planning and Zoning Commission will conduct a public hearing on Monday, December 16, 2019 at 5:00 p.m. at Hayden City Hall Council Chambers, 8930 N. Government Way, Idaho, to consider amendments to the Hayden City Code as follows: 1. Title 1 Chapter 1: Adding a new section "Appeals" to provide the process for the City Council to hear and decide appeals where it is alleged there is error in any order, requirement, recommendation or determination made by the Administrator, department officials and employees in the enforcement of this Code. Adding a new section "Reconsiderations of City Council Decisions" to establish the process for reconsideration of the Council's decision, specifying deficiencies in the decision for which reconsideration is sought. 2. Title 2 Chapter 1: Amending "Appeals of Planning and Zoning Commission" in accordance with the new subsection 1-1-5. 3. Title 3 Chapter 7: Adding a new chapter "Mobile Food Establishment" to establish a pilot program to ensure for the public health and safety, convenience and protection of the City and the citizens of the City while allowing the City Council, city staff, mobile food vendors, businesses, and citizens the opportunity to experience the pilot program and improve on it if the City Council chooses to make the program permanent. 4. Title 4 Chapter 3: Definitions - adding a definition of an animal daycare 5. Title 11: a. Chapter 1: Definitions - amending, deleting, and/or adding definitions for clarity; b. Chapter 1: Adding a new section Administration and Enforcement to address the process by which the City shall follow with respect to non-compliance with the code section, enforcement, and penalties. c. Chapter 5 - 6: to allow for an increased size of an accessory building allowed outright in the zone while still meeting setbacks, maximum lot coverage, and building height restrictions. d. Chapter 8-9: adding animal daycare to the allowed uses of the chapter. e. Chapter 11: To amend and clarify outdoor storage and outdoor sales display areas with respect to types of use and design standards. f. Chapter 13: General Standards Applicable to All Special Uses: Amending the standards of approval by which a special use permit shall be approved. g. Chapter 16: Amendment Procedures: Amendments to the process of an amendment to this title and to reduce the number of public hearings to one with the Planning and Zoning Commission and a public meeting with the City Council; and amending the standards of approval by which an amendment shall be approved. h. Chapter 17: Administrative Review: Amending the process to be in accordance with the new subsection 1-1-5. i. Chapter 18 Section 5: To amend and clarify design standards related to parking, loading berth, storage and display lots. j. Chapter 19: Procedure for Approval of a PUD: Amending the standards of approval by which a planned unit development shall be approved. k. Chapter 20: Standards for Site Plan Approval: Adding a standard of approval to define the scope of improvements and dedications to allow the project to meet legal requirements and to be compatible with present or future development of neighboring land and to determine the need of a construction improvement agreement for frontage improvements and/or off site public infrastructure. l. Chapter 22: Sign Code: Amending, deleting, and adding clarifying language related to the sign code to add clarity to the types of signs allowed with and without a permit, to add electronic message signage in the central business district as an allowed sign type, and to clarify sizes and types of signage allowed.
