NOTICE OF INTENT TO SUBMIT STATE PLAN AMENDMENTS AND SOLICITATION OF PUBLIC INPUT The Idaho Department of Health and Welfare is giving public notice of an impending change to the Idaho Medicaid State Plan. The Department assures these changes are in compliance with 42 CFR 440.386 and 42 CFR 440.345. Idaho Medicaid has solicited input from Idaho's Tribal representatives regarding these changes in compliance with section 5006(e) of the American Recovery and Reinvestment Act of 2009 and its Tribal Consultation Policy. PROPOSED STATE PLAN CHANGES Idaho Medicaid has submitted an application to the Centers for Medicare and Medicaid Services (CMS) for State Plan Amendments (SPAs) and now intends to submit amendments for two 1915(b) waivers: 1) For the "Idaho Smiles" Dental Plan; and 2) For the Idaho Behavioral Health Plan (IBHP). The changes will add the Medicaid Expansion Adult population to those participants covered under the Idaho Smiles Dental Plan and the IBHP, pursuant to Senate Bill 1204aa, aaH enacted by the 2019 Idaho Legislature. The Department will request an effective date of January 1, 2020 for these changes. No public hearings have been scheduled at this time. LEGAL NOTICE Pursuant to, and in compliance with the provisions of section 5006(e) of the ARRA of 2009 and 42 CFR 447.57, the Department of Health and Welfare is giving public notice of an impending change in the Idaho Medicaid State Plan. Idaho Medicaid intends to submit a State Plan Amendment modifying applicable cost-sharing forms and attachments in the State Plan to align with current operational processes, as well as with cost-sharing provisions in IDAPA 16.03.18.207 that pertain to enrollees in the Medicaid YES Program, serving children with Serious Emotional Disturbance (SED). Idaho Medicaid also intends to add provisions to the State Plan to implement cost-sharing for the Medicaid Expansion population of working-age, non-disabled adults; those provisions would go into effect when Medicaid eligibility for this population begins January 1, 2020. Medicaid participants are charged premiums in compliance with the cost-sharing requirements enacted by the Idaho Legislature in Section 56-257, Idaho Code. These State Plan changes will also support the Department in charging a monthly premium to Medicaid YES Program participants whose family income is above Title XIX income limits. Monthly premium amounts have been established at $15 for Medicaid YES Program participants with family incomes above 150% of the Federal Poverty Level (FPL) and equal to or less than 185% FPL. No premium will be charged for families with other health insurance that pays for services before Medicaid. For incomes above 185% FPL and equal to or less than 300% FPL, the premium will be five percent (5.0%) of household countable monthly income. Household countable income is calculated using the modified adjusted gross income, provided to determine financial eligibility, reduced by allowable expenses. Non-payment of the premium amounts assessed will be grounds for disenrollment; however, families that are unable to pay their premiums may request a hardship waiver or premium reduction. Waiver reviews will be based upon documentation of actual expenses for child care, child support, housing and utilities, and out-of-pocket medical expenses (for non-SED children and parents). Beginning in June 2019, Medicaid YES Program enrollees who are subject to premiums will receive premium notices. Notices will include the anticipated amount of the monthly premium, as well as instructions on payment of premiums and how to request a waiver or reduction of the premium. The effective date for the proposed changes is July 1, 2019. Participants will receive their first monthly premium invoice three months after becoming eligible. This delay will ensure the Department is in compliance with the federal requirement that the first premium cannot be due until the member has been eligible for 60 days.
