Defendants HANNAH have affirmatively stated that Plaintiff NORTHLAND ENTERPRISES, L.L.C. has no right to use any portion of Defendants' HANNAH real property to access its property and has confronted Plaintiffs and Plaintiffs' agents on the road and prevented them from using the road. 9. Plaintiffs are entitled to an Order declaring that Plaintiffs and their successors and assigns, have the right to use the subject roads to access Plaintiffs' properties and that Defendants HANNAH be enjoined from interfering with that use. 10. The easements at issue in this case clearly exist and Defendants' HANNAH conduct is unreasonable. 1 1. Plaintiffs are entitled to an Order quieting title in the easement and requiring Defendants HANNAH to remove all objects or obstructions which in any way impede Plaintiffs' use of the easement to access the dominant parcels. 12. Plaintiffs are entitled to an award of their reasonable attorney's fees and costs incurred in bringing this action, with a reasonable sum in the event of default being $150,000.00 subject to review pursuant to I.R.C.P. 54.
