LEGAL NOTICE Pursuant to, and in compliance with the provisions of section 5006(e) of the ARRA of 2009, the Department of Health and Welfare is giving public notice of an impending change in the Idaho Medicaid State Plan. Idaho Medicaid intends to submit a State Plan Amendment in order to align Attachment 4.18-F of the State Plan with cost-sharing provisions in IDAPA 16.03.18.207 that are applicable to enrollees in the Medicaid SED Program (YES) serving children with Serious Emotional Disturbance. The Department is charging a premium to comply with the cost-sharing requirements enacted by the Idaho Legislature in Section 56-257, Idaho Code. These State Plan changes will support the Department in charging a monthly premium to Medicaid SED Program (YES) participants whose family income is above Title XIX income limits. Monthly premium amounts have been established at $15 for Medicaid SED Program participants with family incomes above 150% of the Federal Poverty Level (FPL) and equal to or less than 185% FPL. For incomes above 185% FPL and equal to or less than 300% FPL, the premium will be five percent (5.0%) of the family's countable income. Non-payment of the premium amounts assessed will be grounds for termination of enrollment. Monthly premiums may be waived if the Department determines that the family is unable to participate in the cost of care. Effective January 1, 2019, the Department will begin mailing premium notices to Medicaid SED Program enrollees who became eligible for Medicaid as of November 1, 2018 or earlier. Notices will include the amount of the monthly premium, as well as instructions on how and when to pay the premiums and how to request a waiver of the premium. The public comment period for this State Plan Amendment will close on October 19, 2018. No additional public hearings have been scheduled at this time.
