Trial set for couple accused of battery

The felony trial for a Coeur d’Alene couple who are accused of battering a police officer was set for three days beginning June 6.

Lindsay and Harrison McLean are accused of felony battery on police after a fracas last year resulted in their arrest at Kootenai Health where the couple had gone to the emergency room to seek treatment for Harrison McLean, a U.S. Army green beret and National Guardsman who suffered extreme stomach pain.

Hospital personnel who called police said Lindsay McLean drove the couple’s Toyota the wrong way to the ER — the entrance was under construction at the time — and accused her of being drunk.

McLean told police she had four beers during the day. It was she and her husband’s anniversary, and when officers attempted to arrest her, the fracas ensued.

A hospital surveillance video of the incident was posted Thursday on the Coeur d’Alene Press Facebook page. Coeur d’Alene Police said they have additional body camera video to show another side of the story.

The Mcleans refused plea bargains in the case — including dropping the felony to a misdemeanor with a withheld judgment, Lindsay McLean said, because they feel police had no probable cause and were overly aggressive.

Coeur d’alene Police Capt. Dave Hagar said his department received no complaints from the couple regarding the August incident, and no formal complaints were filed with Coeur d’Alene Police within a 180-day grievance period.

First District Judge Cynthia C.K. Meyer asked parties at Thursday’s pretrial hearing if they knew of any upcoming issues that could postpone the hearing. Attorneys raised no concerns and will file pretrial motions next week before the trial begins.
