IDAHO HEALTH FACILITIES AUTHORITY NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that on Thursday, October 5, 2017, Shelley Shannon, Executive Director of the Idaho Health Facilities Authority, an independent public body corporate and politic under Idaho law (the "Authority"), or her designee, will hold a public hearing for purposes of federal tax law with respect to the proposed issuance of one or more series of hospital revenue bonds (the "Bonds") by the Authority, in an aggregate amount not to exceed $41,000,000. The proceeds of the Bonds will be loaned to Kootenai Hospital District, a hospital district organized and existing under the laws of the State of Idaho (the "Health Institution"), for the purposes of financing or refinancing the costs of issuance of the Bonds and the costs of acquisition and construction of (i) an approximately 7,000 square feet expansion to the Health Institution's emergency department; (ii) a new emergency entrance with ambulance drop off area and waiting room; (iii) additional operating rooms and renovation of existing operating rooms; (iv) expansion of the pre-admittance and post-recovery units; (v) installation of medical equipment and fixtures, including but not limited to DaVinci XI System and table, echocardiogram machines, defibrillators, bed, mattress, and gurney replacements and retinal surgery equipment; (vi) renovation and other improvements of existing patient care and administration areas of the Health Institution, including without limitation, procedure room conversions, air handling unit replacement, administrative building renovations, and lab space reconfiguration; and (vii) installation of information systems, including hardware and software (collectively the "Project"). NOTICE OF PUBLIC HEARING Notice is hereby given that the Hayden Lake Recreational Water and Sewer District ("District") will hold a public hearing to consider any and all comments on a proposal to change the legal designation of the District from a "Recreational" water and sewer district under Idaho Code sections 42-3202A and 3202B, to conform to its new classification by omitting references to "Recreational". The reason for the proposed change is that the District no longer meets the criteria of a recreational sewer district. The District is also proposing to change its name and omit any reference to being a water district because the District no longer provides water services. The legal designation and name changes sought will reclassify the "Hayden Lake Recreational Water and Sewer District" to the "Hayden Lake Sewer District". Additionally, recreational sewer districts permit those who own land within the District to vote in its elections, even where the property owners are not residents of the District. Changing the legal classification from recreational to non-recreational status would permit only residents of the District to vote in District elections. SECTION ONE OF THE ORDINANCE PROVIDES STATUTORY AUTHORITY, FINDINGS OF FACT AND CONCLUSIONS OF LAW. SECTION ONE ALSO REPEALS TITLE 7, CHAPTER 4 OF THE CITY CODE RELATING TO THE CEMETERY BOARD, CEMETERY DIRECTOR AND OTHER RELATED PROVISIONS. FINALLY, SECTION ONE AMENDS TITLE 2, CHAPTER 2 TO INCORPORATE CERTAIN PROVISIONS FROM TITLE 7, CHAPTER 4 CONCERNING CEMETERY ADMINISTRATION. SECTION TWO PROVIDES FOR SEVERABILITY OF THE ORDINANCE SHOULD ANY PORTION OF THE ORDINANCE BE DECLARED INVALID BY A COURT OF COMPETENT JURISDICTION. SECTION TWO ALSO PROVIDES FOR PREEMPTION IN THE EVENT THAT ANY PROVISION OF THE ORDINANCE IS PREEMPTED BY OR LIMITED BY FEDERAL OR STATE LAWS, RULES OR REGULATIONS. SECTION THREE REPEALS ALL CONFLICTING ORDINANCES AND PARTS OF ORDINANCES. SECTION FOUR STATES THAT THE ORDINANCE SHALL TAKE EFFECT AND BE IN FULL FORCE FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION.
