NOTICE OF INTENT TO SUBMIT STATE PLAN AMENDMENTS AND SOLICITATION OF PUBLIC INPUT Pursuant to 42 CFR 441.304 and 42 CFR 447.205, the Idaho Department of Health and Welfare (the Department) provides public notice of its intent to submit Medicaid state plan amendments to the Centers for Medicare and Medicaid Services (CMS) related to the Pharmacy benefit offered under the state plan. PROPOSED STATE PLAN CHANGES The Department is making these changes to comply with changes to federal regulations that became law with the passage of the Covered Outpatient Drug final rule, and the effective date of these changes is July 1, 2017. The changes are not expected to result in any increase or decrease in annual aggregate expenditures, and no public hearings have been scheduled at this time. The Department proposes-and requests public input regarding-the changes described below. 1. Addition to state plan of coverage clarification for 340B contract pharmacies: Drugs acquired through the federal 340B drug pricing program and dispensed by 340B contract pharmacies are not covered. 2. Addition to state plan of provisions describing new reimbursement methods for Physician Administered Drugs: a. Payment to a Medicaid provider will be ninety percent (90%) of the Medicare ASP+6% rate. b. If the ASP+6% rate is not available, the payment will be at the Wholesale Acquisition Cost (WAC). c. Payment to 340B providers will be the actual 340B drug acquisition cost submitted (not to exceed the 340B ceiling price). 3. Addition to state plan of provisions describing new reimbursement methods for providers of Clotting Factor: a. Reimbursement for specialty pharmacies providing clotting factor will be at a state-based price equivalent to the published Medicare ASP+6% price, plus a professional dispensing fee. b. Reimbursement for Hemophilia Treatment Centers providing clotting factor will be their 340B actual acquisition cost (not to exceed the 340B ceiling price) plus a professional dispensing fee. PUBLIC REVIEW The proposed amendments to the state plan will be posted to the Department's website at: http://healthandwelfare.idaho.gov/Medical/Medicaid/tabid/123/Default.aspx. Unless otherwise specified, copies of the amendments are also available for public review during regular business hours at regional or field offices of the Idaho Department of Health and Welfare and regional or local public health district offices.
