COURT: Claim state exemption

I have a simple question regarding the illegal immigrant that shot and killed a woman in San Francisco. Five times he had been deported because of his illegal status, plus having been found guilty seven times of a felony. Even though it is a federal law to deport him, the city of San Francisco claimed itself as a city of sanctuary, therefore thumbing its nose at the federal law.
The federal law now states that same-sex marriage is to be accepted in all states. My question is this: Why don’t states that have overwhelmingly voted against same-sex marriage have the same right as San Francisco and claim that we are exempt from the federal law?
