NOTICE OF PUBLIC HEARING On the 5th day of January 2016, at 5:00 p.m. at City of Hayden Lake City Hall, 9393 N. Strahorn Road, Hayden Lake, Idaho 83835, a hearing will be held by the City Council of the City of Hayden Lake for the purpose of considering several amendments to the City Code. The amendments to City Code Sections 1-11-5.F, 8-3-5 and 9-3-5.E adopt the time to examine and reconsideration period requirements set forth in Idaho Code Sections 67-6519(2) and 67-6535 respectively. The amendment to City Code Section 7-1-2 simply recodifies that Section as Code Section 8-2-7 since the Section relates more to building regulations than public ways and property. The text amendments to Code Section 8-4-6.A implement the amendments previously approved by the Council in Ordinance No. 265, which mistakenly stated that the amendments applied to Code Section 8-4-6.B. The amendments also redact a reference to a definition of "public buildings" in Title 9, Chapter 2 of the City Code since no such definition exists. Similarly, the amendment to Code Section 9-2-1 corrects a statutory citation found under the definition of "family" by citing Idaho Code Section 20-219 instead of 50-219. The amendments to Code Section 9-3-5.A add a minimum lot width requirement of fifty (50) feet unless easements, driveways or roads are being incorporated into a lot. Associated amendments are being proposed for Section 9-8-5 which provide that certain non-conforming lots can be adjusted through the boundary line adjustment process under certain circumstances. The amendments to Section 9-8-5 also establish the requirements for a legal non-conforming lot to remain eligible for a building permit. Finally, the amendments to Code Section 10-3-3.H redact references to a public hearing since no such hearing is required for short plat applications. No later than 4:00 p.m. on the date of the hearing, any person may file with the City Clerk of the City of Hayden Lake, 9393 N. Strahorn Road, Hayden Lake, Idaho 83835, written testimony for inclusion in the record at the hearing. Such testimony must contain the interested party's name and address and the reasons for the testimony. Oral testimony will also be allowed at the public hearing so long as it complies with the requirements of the City of Hayden Lake City Code.
