SUMMARY OF ORDINANCE NO. 2012-01 An Ordinance creating Local Improvement District No. 7A for Hayden Lake Recreational Water and Sewer District, Kootenai County, Idaho; describing and setting forth the boundaries of said local improvement district; providing for the improvements to be made therein; authorizing the advertising for bids for said work as provided by law; providing for the payment of costs and expenses of said improvements to be assessed against the property within the district benefited thereby and the method of assessment; providing for the issuance of local improvement district bonds and/or warrants; providing for the publication of a summary of this ordinance; and providing for other matters properly relating thereto A summary of the principal provisions of Ordinance No. 2012-01 of Hayden Lake Recreational Water and Sewer District, Kootenai County, Idaho (the "District"), adopted on December 12, 2012, is as follows: Section 1. Finds and declares that formation of Local Improvement District No. 7A for Hayden Lake Recreational Water and Sewer District (the "LID No. 7A") is in the best interest of the property affected and the District; there is a reasonable probability that the obligations of LID No. 7A will be paid; the value of the property subject to assessment within LID No. 7A, including the proposed improvements, is sufficient to provide for the repayment of the obligations of proposed LID No. 7A and exceeds the sum of the estimated costs to be assessed against the property; and that a public hearing to consider all protests to the formation of LID No. 7A was held on November 28, 2012, and the Board has reviewed all testimony at the hearing and all written protests presented to the District. Section 2. Creates Local Improvement District No. 7A for Hayden Lake Recreational Water and Sewer District, Kootenai County, Idaho, the boundaries of which are set forth in Exhibit A, attached hereto. Section 3. Describes the improvements to be made within LID No. 7A as follows (the "System Improvements" and "Collector System Upgrade," hereinafter collectively referred to as "Improvements"): A. System Improvements: The System Improvements will include improvements to the Hayden Area Regional Sewer Board (HARSB) regional wastewater treatment facility. These improvements are necessitated by increased water quality requirements of the U.S. Environmental Protection Agency and Idaho Department of Environmental Quality. Specific projects include but are not limited to flow equalization, biological nutrient removal, tertiary filtration, and biosolids treatment improvements. Other improvements to the HARSB facility are related to replacement of depreciated components, including headworks, disinfection, biosolids treatment, and effluent pumping. The System Improvements are more fully described as Alternative 2 in the draft HARSB Wastewater Facilities Plan prepared by JUB Engineers, dated October 17, 2012. The District will participate in these project costs on a "pro-rated" basis, based on the ratio of equity in the facility. B. Collector System Upgrade: The Collector System Upgrade will include improvements to the District's sewer collection facilities, as identified in the draft HLRWSD Wastewater Collection System Facilities Plan, prepared by Welch Comer Engineers, dated February 3, 2012. The Collector System Upgrade will include the installation of gravity sewer relief lines in Strahorn Road. C. Costs of construction will include, but are not limited to, engineering, legal, accounting, costs of bond issuance, costs of interim financing, costs of financial advice, the funding of a guarantee fund or reserve account to secure payment of the financing, and other costs incidental thereto. Section 4. Defines the costs and expenses to be included in the price of the Improvements. Section 5. The total cost of the Improvements shall not exceed $7,000,000, 97% of which shall be borne by and assessed against the properties specially benefited by such Improvements, based upon a benefits derived method of assessment as set forth in Section 50-1707, Idaho Code. Other proposed sources of funds will be approximately 1% from the general funds of the District, and approximately 2% from a future proposed local improvement district. Upon final confirmation of the assessment roll under Idaho Code Section 50-1715, the District anticipates it will permit unpaid assessments to be payable in installments. Section 6. Provides for the issuance of warrants, if necessary, for the immediate payment of the costs of the Improvements, and provides for the issuance of bonds upon the final assessment on the benefited property. Section 7. Incorporates all matters and things done in regard to the creation of LID No. 7A. Section 8. States that the Ordinance shall take effect after its passage, approval, and publication of a summary thereof. Exhibit "A": Provides the boundaries of LID No. 7A.
