30-Day Notice of Comment USDA - FOREST SERVICE Idaho Panhandle National Forests Bonners Ferry, Sandpoint and Priest Lake Ranger Districts Boundary and Bonner County, Idaho Kaniksu Zone Juvenile Tree Thinning and White Pine Pruning Project The Forest Service, Idaho Panhandle National Forests, Bonners Ferry, Sandpoint and Priest Lake Ranger Districts, is proposing to thin and /or prune western white pine on approximately 5,200 acres of juvenile tree stands. The treatment areas are in various locations throughout the Sandpoint, Priest Lake and Bonners Ferry Ranger Districts in Bonner and Boundary County, state of Idaho. A preliminary assessment indicates this proposal falls within the category of actions listed in the Forest Service NEPA Handbook (FSH) that are excluded from documentation in an Environmental Assessment (EA) or Environmental Impact Statement (EIS) and that no extraordinary circumstances exist that would preclude use of the category. (FSH 1909.15, Chapter 31.2, Paragraph 6 - Timber Stand and/or Wildlife Habitat Improvement). The treatments primary objective is to restore ponderosa pine, western larch and western white pine to more historic levels, and to provide future opportunities to establish large diameter, long-lived, and ecologically stable stands of vegetation. The proposed action for this project includes the following: The proposed action is to thin and/or prune western white pine on approximately 5,200 acres of juvenile sapling sized stands, 15 to 30 feet in height, that were established through planting and natural reforestation means, following past timber harvests. The thinning would leave the healthiest trees of the desired species composition, spaced 10 to 15 feet apart increasing the overall health and vigor of the stands. Where western white pine occurs within these stands the lower limbs will be pruned to reduce the susceptibility to white pine blister rust infection. Some of the excess trees cut during the thinning operation could possibly be utilized (salvaged) for special forest products (i.e. Christmas trees, boughs used for wreaths, decorative arrangements, etc). The project will not involve any new road construction and is planned to start during calendar year 2011. ORDINANCE NO. 245 AN ORDINANCE OF THE CITY OF HAYDEN LAKE, IDAHO, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AMENDING SECTION 5 OF CITY ORDINANCE NO. 148 TO PROVIDE THAT THE COMPLIANCE REQUIRED THEREIN BY AVISTA UTILITIES, THE GRANTEE OF A PUBLIC UTILITY FRANCHISE, WITH CITY ORDINANCES IS LIMITED BY THE RESTRICTIONS SET FORTH IN IDAHO CODE SECTION 50-329A(1)(E), SETTING FORTH AUTHORITY FOR SUCH ACTION, FINDINGS OF FACT AND CONCLUSIONS OF LAW; PROVIDING FOR SEVERABILITY, PREEMPTION AND PRECEDENCE; PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR SUSPENSION OF THE RULES. Statutory Authority The Legislature of the State of Idaho in Idaho Code Section 50-329 provides that franchise ordinances adopted by a city can be amended provided that such amendment is not passed within thirty (30) days of its introduction or before such amendment is published in the official newspaper of said city. B. Findings of Fact and Conclusions of Law Section 7-4-15(B) of the City Code formerly stated that "[t]he city shall require that compaction testing by an independent consultant be performed during backfill and grading operations. The cost of such testing shall be borne by the permittee." In May of 2010, Avista Utilities ("Avista"), one of two existing utility franchises in the City, sought an exemption from the requirements of 7-4-15(B) for several reasons, including but not limited to the potential for delays associated with compaction testing, Avista's internal controls that it believes assure that proper compaction will be achieved and Avista's guaranty of its work. Avista's request was initially considered by the City Council at the Council's May 17, 2010 meeting. After hearing from Mr. Rick Berger, Regional Business Associate for Avista, and discussing the matter on the record, the Council decided to refer the matter to the City's Code Review Committee. Such Committee met on June 2, 2010 and instructed the City Attorney to send Avista a letter explaining that the Committee didn't believe that the requested exemption should be granted since Ordinance No. 148, which grants Avista's franchise within the City, states in Section 5 that "[g]rantee (Avista) shall comply with all valid ordinances of the City relating to construction, excavation, and the breaking, opening and closing of ground in public streets and properties." Since Section 7-4-15(B) of the City Code is part of a valid City ordinance, the Committee felt that Section 5 of Ordinance No. 148 mandated that Avista comply with Section 7-4-15(B). The Committee also questioned Avista's allegation that the required compaction testing would cause unwarranted delays since lab results for compaction testing usually aren't needed before a subject section is permanently patched when fill materials with a known proctor are used. Finally, the Committee gave Avista the option to be put on the agenda for a future City Council meeting if Avista didn't agree with the Committee's analysis. Avista didn't agree with the Code Review Committee's analysis of the issue and requested to be put on the Agenda for the City Council's July 20, 2010 meeting. Avista also sent a letter to the City Attorney dated July 23, 2010 stating that Avista desired to "appeal" the Code Review Committee's "decision". In this letter, Mr. Rick Berger stated that Avista now believed that requiring Avista to comply with Section 7-4-15(B) of the City Code violates Idaho Code Section 50-329A(1)(e). Idaho Code Section 50-329A(1)(e) states that: "Franchise fees paid by public service providers will be in lieu of and as payment for any tax or fee imposed by a city on a public service provider by virtue of its status as a public service provider including, but not limited to, taxes, fees or charges related to easements, franchises, rights of way, utility lines and equipment installation, maintenance and removal during the term of the public service provider's franchise with the city." At the July 23, 2010 meeting of the City Council, Mr. Berger provided testimony that essentially reiterated what was stated in his letter to the City Attorney dated June 23, 2010. Mr. Berger also stated that, if the exemption is granted, all the City has to do if there's a problem with one of Avista's road cuts is call Avista and Avista will come fix the problem. After discussing the matter, a majority of the City Council voted to approve the request for an exemption due in main part to the language found in Idaho Code Section 50-329A(1)(e) so long as Avista agreed in writing to fix any compaction deficiencies for its right of way encroachments within twenty-four (24) hours of being notified of the same. The Council also directed that the City Code be amended accordingly so that this exemption fairly applies to all utility franchises granted by the City. At a November 16, 2010 meeting of the City Council, the Council re-visited the decision it made at the July 23, 2010 meeting due to issues with some of Avista's recent right of way encroachments. After discussing the matter, a majority of the City Council voted to revise its previous decision by requiring Avista and other utility franchises to perform compaction testing, with the costs of such testing to be borne by the City. For this reason, along with the powers granted to the City by Idaho Code Sections 50-313 and 50-314, the City Council adopted Ordinance No. 243 at its December 7, 2010 meeting, which amended subsection 8-4-7(D)(1)(d) of the City Code as follows: Compaction Testing. The city shall require that compaction testing by an independent consultant be performed during backfill and grading operations. The cost of such testing shall be borne by the permittee. , unless the permittee is an entity that has been granted a utility franchise by the city, in which case the city shall bear the cost of compaction testing. In order to avoid future interpretations of Section 5 of Ordinance No. 148 that conflict with the restrictions that are set forth in Idaho Code Section 50-329A(1)(e), the Council also adopts the following amendments to Section 5 of Ordinance No. 148. C. Amendments Section 5 of Ordinance No. 148 is hereby amended as follows: For the purpose of carrying into effect the privileges granted hereunder, Grantee is authorized at any time to make all necessary excavations in the public right-of-way and public property within the franchised area, but such excavation shall be carried out with reasonable dispatch and with as little interference with or inconvenience to the rights of the public as may be feasible. Grantee shall restore all streets, alleys, roads, rights-of-way and public grounds to their original condition of safety and utility after excavation as expeditiously as possible and without undue delay. The Grantee shall provide at least seven (7) days written notice to the City of any intended excavations unless emergencies make such notice practically impossible. The Grantee shall repair and restore to as good or better condition all public and private properties disturbed during the construction, maintenance, repairing or removal of its electrical distribution system. Whenever deemed necessary by the proper City authorities, the City shall have the right to appoint its engineer or a competent and experienced person to superintend and supervise the refilling of excavations made, and the expense of replacing and repairing of the portion of the public properties disturbed in the construction, laying, operation and the maintenance of Grantee's electrical system shall be at the expense of the Grantee. Should the Grantee fail or refuse to restore and replace the same to as good as or better condition of such public and private properties within a reasonable period after completion of Grantee's construction, laying, removal, operating and maintaining work, the same may be restored by the City at the expense of the Grantee. Grantee shall comply with all valid ordinances of the City at the expense of the Grantee. Should any portion of this Ordinance be declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purpose(s) of the Ordinance before the declaration of partial invalidity. In the event that federal or state laws, rules or regulations preempt a provision or limit the enforceability of a provision of this Ordinance, then the provision shall be read to be preempted to the extent and for the time required by law. In the event such federal or state law, rule or regulation is subsequently repealed, rescinded, amended or otherwise changed so that the provision hereof that had been preempted is no longer preempted, such provision shall thereupon return to full force and effect, and shall thereafter be binding without the requirement of further action by the City, and any amendments to this Ordinance as a result of such provision being preempted shall no longer be of any force or effect with respect to that provision. SECTION THREE: REPEAL OF CONFLICTING ORDINANCES All Ordinances and parts of Ordinances in conflict with the provisions of this Ordinance to the extent of such conflict are hereby repealed.
