NOTICE OF 30-DAY PUBLIC COMMENT PERIOD AND HEARING REGARDING PROPOSAL ON OPEN BURNING OF CROP RESIDUE PROPOSED ACTION: The Department of Environmental Quality (DEQ) is proposing to submit an Open Burning of Crop Residue State Implementation Plan (SIP) Revision to the Environmental Protection Agency (EPA) pursuant to the requirements of Section 110 of The Clean Air Act. The new crop residue burning rules have been in effect since 2008. Upon completion of the second year of burning under these new rules, it became apparent that some smaller crop residue burns could and should be regulated differently than those large-scale, high-fuel content burns. This SIP addresses small fuel-loading and small acreage burns including propane flaming, spot burns, burns of one acre or less, and broken bales. DEQ determined that the administrative requirements of both the grower and DEQ for these types of burns were unnecessarily burdensome when compared to the minimal potential air quality impact. This SIP revision streamlines the administrative requirements for the growers and DEQ while retaining the control measures necessary to ensure air quality protection.
