ORDINANCE NO. 540 AN ORDINANCE OF THE CITY OF SPIRIT LAKE, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO; ESTABLISHING A TREE COMMITTEE, PROVIDING FOR THE MEMBERSHIP, TERMS OF OFFICE AND COMPLIANCE WITH OPEN MEETING LAWS; ESTABLISHIING THE DUTIES AND AUTHORITY OF THE TREE COMMITTEE; REQUIRING A PERMIT TO PRUNE OR TRIM TREES ON PUBLIC PROPERTY AND PROVIDING THE APPLICATION PROCESS; PROVIDING DEFINITIONS; ESTABLISING THE DUTIES OF PROPERTY OWNERS ADJACENT TO PUBLIC ROADS, SIDEWALKS AND PARKWAYS; PROHIBITING ABUSE TO PUBLIC TREES; PROVIDING THAT A VIOLATION IS PUNISHABLE BY A FINE NOT TO EXCEED ONE THOUSAND DOLLAR, SIX MONTHS IN JAIL, OR BOTH; PROVIDING SEVERABILITY; PROVIDING REPEAL OF CONFLICTING ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. Members shall be selected without respect to political affiliation and shall serve without compensation. A. Organization and Meetings: Meetings of the Committee shall be held when duly called by the chairman upon reasonable prior written or oral notice. B. The Committee shall consist of 5 members, each serving a 3 year term. Member shall be appointed by the mayor, with the advice and consent of the city council. C. A majority of the appointed members of the Committee shall be necessary to constitute a quorum at any meeting. D. All meetings shall be open to the public and shall comply with the open meeting laws, including keeping a written record of the meetings. SECTION 2: Duties and Authority of Committee: A. The Gem Tree Committee is an advisory committee and shall have the following duties and authority: 1. At the direction of the Mayor, supervise planting, pruning, spraying, preserving and removing of trees and other work authorized by this Chapter; 2. Prepare and recommend to the city council rules and regulations containing guidelines for the pruning of trees; 3. Prepare and recommend a tree list consisting of acceptable varieties, size of trees, property planting and spacing instructions for trees; 4. Provide advice to the Mayor and City Council as to appropriate practices for the preservation, protection and management of trees subject to this Chapter. 5 Assist the City in taking an inventory of all existing trees on all City properties. 6. Assist the City in providing information to the public through educational campaigns, published material and other opportunities. 7. Assist the City in implementing Arbor Day celebrations and activities. 8. Encourage and seek other funding for City tree projects. 9. Identify and recommend suitable landscaping projects to the City council for City property. 10. Assist the City in the planning and budget process by making recommendations to the Mayor and City regarding budget issues relating to City tree projects. SECTION 3: Permit Required For Action to Trees; Application A. It shall be unlawful for any person not a city employee or agent to plant, remove, trim, cut or in any way damage any tree or within real property owned or controlled by the City without first procuring an encroachment permit to do so from the City Clerk, provided, that no permit shall first be required in situations where the delay entailed in obtaining a permit would place life, limb or property in immediate jeopardy of harm. B. Any person desiring a permit to plant, remove, cut or in any way damage a tree on or within the City properties shall file with the City Clerk an application to do so on forms to be furnished by the City Clerk setting forth therein in detail the work that is contemplated and the location and address of the same. Upon the filing of such application, the City shall investigate the contemplated work and if in its judgment it is desirable and within the parameters of this Chapter, shall issue a written permit therefore; provided that the work authorized in such permit shall be done under the supervision of the City or the City's designee. SECTION 4: Definitions For the purpose of this Chapter whenever the following words are used, the intent and meanings shall be interpreted as follows: A. "Owner": The legal owner or owners of the real property adjacent to a public street in the City of Spirit Lake, Idaho. B. "Hedges and shrubbery": Any plant of more than two feet (2') but less than eight feet (8') in height. C. "Parkway": That portion of a street between a roadway and a sidewalk. D. "Person": Any individual, firm, partnership, limited liability company, association, corporation, group or combination acting as a unit. E. "Roadway": That portion of a street improved, designed or ordinarily used by the public for vehicular travel. F. "Sidewalk": That portion of a street improved, designed or ordinarily used by the public for pedestrian travel. G. "Street": The entire width between the boundary lines of a public right of way dedicated or deeded to the City for use of the public for purposes of vehicular travel, whether or not maintained by the City and whether or not open for vehicular traffic. H. "Trees": Any plant which at maturity would exceed a height of more than eight feet (8'). I. "City property": Real property dedicated, deeded or leased to the City or including, but not limited to, public rights of way and City parks. SECTION 6: Trimming and Pruning of Trees A. Each owner of property abutting the public right of way shall at all times keep pruned and trimmed all trees, bushes, branches, leaves and roots of tress or bushes on any portion of the owner's property which abut the public roadway, sidewalk for parkway in order to prevent such tree branches, roots, leaves or bushes from protruding into an area that is between the surface of the sidewalk, parkway or roadway and thirteen feet (7') above the surface in order to keep a clear space. B. Each owner of property shall also treat or remove any tree or plant so diseased or insect-ridden as to constitute a hazard to trees or plants in public places. Such tress or plants are herby declared a nuisance. C. Any tree or bush growing on private property which shall endanger or damage the usefulness of any street, roadway, sidewalk, parkway or public sewer or water line, is hereby declared to be a public nuisance, and the property owner shall be responsible for the pruning and trimming of such branches, leaves and roots to prevent such trees from damaging or endangering the usefulness of any street, sidewalk, roadway, parkway, or public sewer or water line. SECTION 7: Unlawful to Abuse Trees It shall be unlawful for any person to abuse, damage or mutilate any tree, in any parkway, or in any public place, including but not limited to the following: 1. Attach any sign, poster, handbill, advertisement or other thing to or on such a tree; 2. To cause or permit any wire charged with electricity to come in contact with such a tree; 3. To cause or permit any gaseous, liquid or solid substance which may be harmful to any such tree to come in contact with the tree. SECTION 8: Hedges and Shrubbery Any owner, agent, tenant or occupant of any real property shall trim all hedges and shrubbery adjacent to public sidewalks so that no part of said hedges and/or shrubbery shall extend over any part of a public sidewalk in the City. SECTION 9: Penalty Any violation of any provision of this Chapter shall be punishable by a fine not to exceed one thousand dollars ($1000.00), or six months in jail, or both fine and jail, per occurrence. Section 10: Severability. The ordinance is hereby declared to be severable. Should any portion of this ordinance be declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purpose(s) of the ordinance before the declaration of partial invalidity. Section 11: Repeal of Conflicting Provisions. All provisions of the current Spirit Lake Municipal Code or ordinances of the City of Spirit Lake which conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict. Section 12: Effective Date. This ordinance shall be effective upon passage and publication as provided by law.
