PROP ONE: More extreme than supporters say

The “yes” letters frame Prop 1 as simply trusting women and restoring reasonable care. That is not what the measure does.

Prop 1 redefines “fetal viability” as the point when a fetus has “a significant likelihood of sustained survival outside of the uterus without extraordinary medical measures” (§ 39-803(5)(d)). This allows abortion for any reason well into the later months of pregnancy — long after a baby can feel pain — and goes beyond the traditional viability standard used under Roe.

Its “right to privacy” applies to “every person” (§ 39-803(2)(a)), with no age limit and language that overrides conflicting laws. This removes parental knowledge or consent for minors seeking abortion.

It also defines “health care provider” broadly as any “licensed person or an entity that provides health care” and shields them from liability, eliminating the current physician-only requirement.

Idaho’s current law already protects the unborn while allowing narrow exceptions for the mother’s life and first-trimester rape or incest. Prop 1 does not restore balance — it erases those protections, including parental rights.
