CATS: More rights than property owners

My neighbor allows his cat to run free. I have asked them to not let their cat on our property. In addition to marking his territory on our house and greenhouse he has started attacking our song birds from underneath our front porch.
I called Animal Control today and the officer told me under Idaho state law cats are allowed to roam free anywhere. I asked if I could catch or kill it and was told I could only use non-lethal barriers (she suggested moth balls or pepper flakes).
My point is that the cat has more rights than I have as a property owner. It can come and go on our land as he wishes and my only deterrent is to surround our 10 acres with moth balls. This is absolutely mind boggling.
