PROP 1: Voters deserve the facts

A recent letter opposing Proposition 1 makes several alarming claims, including that it would allow abortion on demand into the eighth month, eliminate parental involvement and allow non-physicians to perform abortions. Those claims deserve some important context.

Proposition 1 protects abortion before fetal viability, determined based on the individual pregnancy and a health care provider’s good-faith medical judgment. It does not establish the eighth month as the point of viability, nor does it state that a baby must survive without oxygen or NICU care. The phrase “extraordinary medical measures” is not specifically defined, and questioning that language is fair. Presenting one interpretation as established fact is not.

The claim about parental consent also goes further than the text. Proposition 1 uses the term “every person,” but it does not explicitly repeal Idaho’s parental-consent law. How existing laws involving minors would interact with the amendment would be a legal question.

Likewise, using the term “health care provider” does not mean an unqualified person could perform an abortion. Providers remain subject to Idaho licensing and scope-of-practice requirements.

There are legitimate reasons to support or oppose Proposition 1, and there are legitimate questions about how portions of it could ultimately be interpreted. Idaho voters deserve an honest discussion of those questions.

This decision is important enough that we should debate what Proposition 1 actually says — not present the most extreme possible interpretation of its language as certainty.
