CITY OF SMELTERVILLE ORDINANCE 2025-003 AN ORDINANCE OF THE CITY OF SMELTERVILLE, A MUNICIPAL CORPORATION PURSUANT TO THE LAWS OF THE STATE OF IDAHO; ENACTING A NEW CODE PROHIBITING THE TEMPORARY PARKING OF TRUCKS, TRACTOR TRUCKS, SEMITRAILERS, OR TRANSPORTERS; PROHIBITING EXTENDED PARKING IN CITY ALLEYWAYS; AUTHORIZING THE CITY TO DESIGNATE NO PARKING AREAS AND PROHIBITING PARKING IN SUCH AREAS; AUTHORIZING CERTAIN PERSONNEL FOR ENFORCEMENT; PERMITTING TOWING OF VEHICLES AND/OR PROPERTY FOR VIOLATIONS; REPEALING CONFLICTING ORDINANCES; PROVIDING SEVERABILTY; AND PROVIDING AN EFFECTIVE DATE UPON PASSAGE AND PUBLICATION. WHEREAS, Idaho’s Constitution, Article 12, Section 2 authorizes any City to make and enforce their policing power in regulations that are not in conflict with general laws; and WHEREAS, Idaho Code Section 50-302 directs the City to make all such ordinances not inconsistent with laws of the State of Idaho which may be expedient to maintain the health and welfare of the citizens of the City; and WHEREAS, the City of Smelterville has decided that regulating vehicle traffic and limiting parking in certain areas will promote the health and welfare of the motoring public and the residents within the City limits; and WHEREAS, removal of the vehicles by way of towing has been determined by the City as an efficient and cost-effective remedy to abate violations of such parking restrictions. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF SMELTERVILLE, SHOSHONE COUNTY, STATE OF IDAHO: Section 1: TEMPORARY PARKING OF TRUCK OR SEMITRAILERS – It shall be unlawful for any person to park or permit any tractor truck, semitrailer, or transporter as defined by Idaho Code § 49-121(6), (9), and (10) on the streets or street right-of-way or City property at any time except for the expeditious and actual loading or unloading of the vehicle for a period not to exceed fifteen (15) minutes. In the event loading or unloading is going to exceed fifteen (15) minutes, the driver shall notify the city clerk or code enforcement officer at least thirty (30) minutes prior to such parking and will park the vehicle in such a manner as to minimize the impact on the flow of traffic. Section 2: FIVE MINUTE PARKING IN PUBLIC ALLEY WAYS – No person shall leave any motor vehicle or personal property parked or unattended, at any time, in any alley within the city for more than five (5) minutes. Section 3: PARKING IN AREAS DESIGNATED AS NO PARKING – The city council shall, from time to time, establish as it deems proper and necessary for the control of traffic, no parking zones on the streets of the City. Such designations shall be marked with signage or by painting the adjacent curb red in color. It shall be unlawful for any person to park or leave parked or standing or unattended any automobile, motor driven vehicle, trailer, trailer house, boat, recreational vehicle, any other type of vehicle, or personal property in any area which has been designated as a no parking area. Section 4: AUTHORITY – The City Code Enforcement Officer or any law enforcement officer has the authority to enforce the provisions of this Ordinance by ordering the owner, operator, or possessor of the vehicle or personal property to remove the item in violation of this Ordinance and/or to order the item in violation to be towed by a local towing company. If at any time the Code Enforcement Officer or a law enforcement officer deems the vehicle, including trucks, tractor truck, semitrailer, or transporter, or other personal property to be impeding on or impacting the flow of traffic, they have the authority to order the owner or operator to move the item or to order the item towed from the location. Section 5: VIOLATIONS – Any person violating any provisions of this Ordinance shall be subject to having the intervening vehicle, motor driven vehicle, trailer, trailer house, boat, recreational vehicle and/or personal property towed by a local towing company. All costs for the execution, storage, and/or fees for the towing shall be the sole responsibility of the owner of such vehicle and/or property. Section 6: REPEAL OF CONFLICTING ORDINANCES – The City Council hereby repeals any City code currently in effect to the extent that it conflicts with this ordinance. Section 7: SEVERABILITY – The provisions of this ordinance are declared to be severable. If any section, sentence, clause or phrase of this ordinance shall for any reason be held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this ordinance, but shall remain in effect, it being the intent of the City that this ordinance shall remain in effect notwithstanding the invalidity of any part. Section 8: EFFECTIVE DATE – That his ordinance shall take effect and be in full force upon its passage, approval, and publication, in the Shoshone News Press in accordance with Idaho Law. ORDINANCE 2025-004 AN ORDINANCE OF THE CITY OF SMELTERVILLE, A MUNICIPAL CORPORATION PURSUANT TO THE LAWS OF THE STATE OF IDAHO, ENACTING A NEW CODE PROHIBITING UNAUTHORIZED PUBLIC CAMPING OR SLEEPING; DEFINING PERTINENT TERMS; PROVIDING EXCEPTIONS; ESTABLISHING PENALTIES AND ENFORCEMENT; REPEALING CONFLICTING ORDINANCES; PROVIDING SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE UPON PASSAGE AND PUBLICATION. WHEREAS, Idaho’s Constitution, Article 12, Section 2 authorizes any City to make and enforce their policing power in regulations that are not in conflict with the general laws; and WHEREAS, Idaho Code Section 50-302 directs the city to make all such ordinances not inconsistent with the laws of the State of Idaho which may be expedient to maintain the health and welfare of the citizens of the city; and WHEREAS, Idaho State Senate Bill 1141, enacting a new Idaho Code Section 67-2341, signed into law and will be in full force and effect on July 1, 2025, prohibits large municipalities, where the population exceeds or is equal to one-hundred thousand (100,000) people, from permitting or allowing public camping or sleeping within city limits; and WHEREAS, the City of Smelterville, even as a city with a population less than one-hundred thousand (100,000) people, has decided that prohibiting unauthorized public camping or sleeping on public property, public building grounds, public parks, public roads or alley ways, public school bus or public transport shelters, public sidewalks and/or public rights-of-way is in the best interest of the city, its residents and businesses and promotes the health, welfare, and safety of the public. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF SMELTERVILLE, SHOSHONE COUNTY, STATE OF IDAHO. Section 1: DEFINITION OF PUBLIC CAMPING OR SLEEPING – For the purpose of this section, the following definition shall apply: “Public Camping or Sleeping” means unauthorized lodging or residing in a temporary outdoor habitation used as a dwelling, lodging, or living space, including sitting, lying, or sleeping for a prolonged period of time, and which may be evidenced by the erection of a tent or other temporary shelter, including a motor vehicle as defined in Idaho Code Section 39-6501, or a recreational vehicle as defined in Idaho Code Section 49-119, and may include, but is not limited to the presence of bedding, pillows, cooking appliances, heat sources, or storage of personal belongings. Section 2: PUBLIC CAMPING OR SLEEPING PROHIBITED – It shall be unlawful for any person to camp or sleep on any public property, public building ground, public park, public road, public alley way, public school bus/transport shelter, public sidewalk, public right-of-way, and/or public walkway. It shall also be unlawful to camp, sleep, or remain in a public space thereby creating any hinderance, obstacle, or barrier that interferes with the use of a public walkway or entrance to a public space. Section 3: EXCEPTIONS – This ordinance shall not prohibit or prevent overnight camping for recreational or educational purposes on property designated for such purposes, during authorized specific temporary events or for activities which are in compliance with applicable established rules and regulations. This Ordinance will not be applicable to or affect policies, rules, statutes, or leases regarding endowment lands, department of parks and recreation lands, or department of fish and game lands. The provisions of this Ordinance also shall not apply to commercial vehicles or commercial motor vehicles as defined in Idaho Code Section 49-123(2)(d). Section 4: VIOLATIONS AND ENFORCEMENT – Any person in violation of this Ordinance shall be guilty of trespassing and shall be subject to the penalties as defined in Idaho Code Sections 18-7008(2)(b) and/or (3). The City’s Code Enforcement Office or any law enforcement officer has the authority to enforce the provisions of this Ordinance through issuance of a citation and/or removing the individual(s) from the public area. Section 5: REPEAL OF CONFLICTING ORDINANCES – The City Council hereby repeals any City code currently in effect to the extent that it conflicts with this ordinance. Section 6: SEVERABILITY – The provisions of this ordinance are declared to be severable. If any section, sentence, clause or phrase of this ordinance shall for any reason be held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this ordinance, but they shall remain in effect, it being the intent of the City that this ordinance shall remain in effect notwithstanding the invalidity of any part. Section 7: EFFECTIVE DATE – That this ordinance shall take effect and be in full force upon its passage, approval, and publication, in the Shoshone News Press in accordance with Idaho law.
