CITY OF HARRISON REQUEST FOR PROPOSAL - CITY ATTORNEY SERVICES INTRODUCTION: The City of Harrison is seeking a contract attorney or legal firm to serve as City Attorney and provide civil legal services as set forth in Idaho Code Sections 50-204 and 50-206. The City Attorney will be an independent contractor, not an employee of the City, and as such will not receive any employee benefits. The City invites interested law firms and individuals with a minimum of five years of municipal law experience representing municipal or other governmental entities in the State of Idaho to submit a written proposal to provide City Attorney services.  As City Attorney, the selected law firm or individual will be expected to provide a wide range of legal services to the City. The City Attorney is appointed by the City Mayor and confirmed by the City Council and works closely with the City Council, Mayor, and City staff. Please identify any foreseeable or potential conflicts of interest which would result from such representation and the manner in which you would propose to resolve such conflicts. Compensation and Reimbursement The City Attorney will be required to attend City Council meetings which are regularly scheduled for the 1st Tuesday of each month beginning at 6:00 p.m. Occasionally, the City may also schedule executive sessions which will require the attendance of the City Attorney and special meetings which may or may not require the attendance of the City Attorney. The City can accommodate participation in some, but not all, meetings electronically via online meeting tools.  In addition, the City Attorney will be required to attend public hearings before the Planning & Zoning Commission. This may also be accomplished via online meeting tools, if necessary. Attendance at regular meetings of the Commission is not required but some projects undertaken by the Planning and Zoning Commission require City Attorney involvement.  Attendance at a periodic meeting with the Mayor and/or City staff as needed may also be required. This meeting may be conducted by teleconference as agreed.  Related duties will include rendering legal advice and opinions concerning legal matters that affect the City. Legal work pertaining to property acquisitions and disposals, annexation, public improvements, easement dedications, right-of-way abandonment, enforcement of City codes, zoning regulations, and building standards through administrative and judicial actions will be performed. The monitoring of pending and current state and federal legislation and court decisions that may impact the City is expected. The selected City Attorney will be expected to provide services under a retainer fee format with additional special legal services provided at a fixed hourly rate by the firm regardless of individual attorney billing rates. We are not low-bidder oriented; we want quality and availability as a premium. Interested proposers should anticipate at least 10 hours per month of work.  Please define what type of work you would consider being extra or specialized work that would be billed in addition to basic services and affirm your understanding of the scope of services to be provided under a retainer fee, including the associated fee proposal.  The City reserves the right to contract with other outside counsel for specific and complicated litigation matters. EVALUATION AND SELECTION PROCESS: All proposals must be received by the City Clerk by 3:00 p.m. on March 30th, 2023. Proposals will be screened and the top candidate(s) will be selected by a committee consisting of the Mayor, Council President, and another Council member.  In reviewing the proposals, the City will carefully weigh:  1. Depth and breadth of experience and expertise in the practice of law, most specifically in those areas most often encountered in municipal government operations;  2.
