NOTICE OF INTENT TO SUBMIT STATE PLAN AMENDMENT AND SOLICITATION OF PUBLIC INPUT The Idaho Department of Health and Welfare Division of Medicaid (Department) provides public notice of impending changes to the Idaho Medicaid State Plan and/or CHIP State Plan, as required by 42 C.F.R. § 447.205. The Department assures these changes are in compliance with 42 CFR§ 440.345, 42 CFR§ 440.386, 42 CFR§ 447.204, 42 CFR§ 447.205, 42 CFR§ 457.30, and with the provisions of section 5006(e) of the ARRA of 2009. Medicaid has solicited input from Idaho's Tribal representatives regarding these changes in compliance with section 5006(e) of the American Recovery and Reinvestment Act of 2009 and its Tribal Consultation Policy. It also amended sections 1902(a)(10)(A) and 1937(b)(5) of the Act to make coverage of this new benefit mandatory under the state plan and any benchmark or benchmark equivalent coverage also referred to as alternative benefit plans, or ABPs with respect to items and services furnished on or after January 1, 2022.
