NOTICE OF PUBLIC HEARING TERMINATION OF ZONE DEVELOPMENT AGREEMENT REQUEST NOTICE IS HEREBY GIVEN that the City of Hayden Planning and Zoning Commission will conduct a public hearing on Monday, August 29, 2022 at 5:00 p.m. at Hayden City Hall Council Chambers, 8930 N. Government Way, Idaho, to consider Case No. PZE-22-0096 Westbrook Termination of Zoning Development Agreement, the owners Glenn and Kathi Westbrook, are requesting approval of the termination of the Zoning Development Agreement tied to their property from October 2, 2006. The original Zoning Development Agreement was tied to 1815 W Honeysuckle Avenue, Hayden, Idaho, which at the time of the Written Decision, was 2.4 acres and zoned Agricultural (A). A request for a Zone Map Amendment changing the zone from Agricultural (A) to Single Family Residential (R-1) was noticed, and as a condition of approval the City Council approved the zone map amendment request conditioned upon a Zoning Development Agreement to limit the number of allowed dwellings to two. At the time of the minor subdivision, this agreement was followed and Eric and Cynthia Draper were limited to a two-lot subdivision. This subdivision created two buildable lots at 1815 W Honeysuckle Avenue and 1875 W Honeysuckle Avenue, both of which have existing single family residential structures with the usual residential accessory structures. The owners of 1815 W Honeysuckle Avenue are now requesting the termination of the Zoning Development Agreement as they would like to re-plat their existing two lots: one lot with an existing Single Family Residential structure and outbuildings totaling 1.2 acres and one unbuildable lot totaling 0.11 acres for a total of 1.31 acres into two buildable lots meeting building setbacks and design requirements of the underlying Single Family Residential (R1) zone designation. The legal description of the subject site is as follows: Lot 1, Block 1, Draper's Acres, according to the plat recorded in Book K of Plats, Page 69, records of Kootenai County, Idaho.
