HAYDEN — A man is being held on $60,000 bail after he was charged with his third DUI violation in three years.

Anthony D. Housley, 40, is charged with excessive DUI, a felony, and with possessing an open container, a misdemeanor.

A blood alcohol level of 0.08 or more is considered impaired. Excessive DUI refers to a blood alcohol level of 0.20 or higher.

Housley has three prior DUI convictions, prosecutors said, including one in March 2019 and one in January 2021.

Police pulled Housley over in Hayden on Monday evening for an alleged traffic violation.

There was an open beer in the front center console, police said, and Housley had difficulty walking when he exited the vehicle.

Housley provided breath samples of 0.26 and 0.25, according to court documents — more than three times the legal limit.

Judge John Cafferty ordered Tuesday that Housley be held on $60,000 bail.

In Idaho, a third DUI violation within 10 years is a felony punishable by up to a decade in prison and up to a $5,000 fine.
