Police: Man’s BAC was four times legal limit

COEUR d’ALENE — A man is being held on $100,000 bail after his third DUI-related arrest since July.

Post Falls resident Nicholas S. Rowley, 33, is charged with excessive DUI and possession of open container by a driver, both misdemeanors.

Excessive DUI refers to a blood alcohol level of .20 or higher. In Idaho, a blood alcohol level of .08 or more is considered impaired.

Police responded Tuesday to a report of an erratic driver in a white Dodge truck.

The driver, identified as Rowley, was found parked outside a liquor store in Coeur d’Alene. The truck was reportedly running when police arrived.

Rowley allegedly told police he’d been drinking wine directly from the bottle. He provided a breath sample of .31, according to court documents — just shy of four times the legal limit.

Police arrested Rowley at the scene.

Rowley has two other pending excessive DUI cases, according to court documents. He was reportedly arrested for excessive DUI in Benewah County in July and in Kootenai County in December.

If convicted in either case, police said, subsequent DUI arrests would become felonies.

Judge James Combo ordered Wednesday that Rowley be held on $100,000 bail.
