A Post Falls man is facing charges connected to a fatal accident earlier this year.

Jeremy Riggs has been charged with misdemeanor vehicular manslaughter and misdemeanor destruction of evidence, according to the Kootenai County Prosecutor’s Office.

He has a pretrial conference scheduled on Dec. 15 at 1:30 p.m. and a trial conference scheduled on Jan. 3 at 8:30 a.m.

According to an Idaho State Police press release, David L. Mallery had exited the Walmart at 3050 E. Mullan Ave. on Feb. 27 and was walking north through the parking lot about 8:40 a.m. when he was struck by a 2013 Dodge Ram pickup driven by Riggs.

Riggs was southbound in the parking lot when he made a left turn in front of the store and hit Mallery, who died at the scene, police said.

ISP later asked witnesses to come forth during its investigation.

According to the complaint related to the evidence destruction count, Riggs, on Feb 27, “did willfully destroy, alter, and/or conceal certain property or substance, to-wit: information regarding phone calls from a cellular device belonging to Jeremy Scott Riggs, knowing that said property or substance was about to be produced, used and/or discovered as evidence in a criminal investigation, and with the intent to prevent it from being produced, used or discovered …”

Kootenai County Prosecutor Barry McHugh declined to comment on the case.
