KOOTENAI COUNTY WATER DISTRICT NO. 1 Kootenai County, Idaho RESOLUTION NO. 2021-02 A RESOLUTION DECLARING AN EMERGENCY AND TEMPORARY SUSPENSION OF NEW WATER HOOK-UPS BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE KOOTENAI COUNTY WATER DISTRICT NO. 1; WHEREAS, pursuant to Idaho law, the purpose of Water Districts is to promote the health, safety, prosperity, security and general welfare of the inhabitants of the District; and, WHEREAS, pursuant to Idaho law, the Board of Directors has the power to acquire, dispose of and encumber real and personal property, water, water rights, water and sewage systems and plants, and any interest therein, including leases and easements within or without the District; and, WHEREAS, pursuant to Idaho law, the Board of Directors has and may exercise all rights and powers necessary or incidental to or implied from the specific powers granted under Title 42, Chapter 32 of the Idaho Code, and such powers are not considered a limitation upon any power necessary and appropriate to carry out the purposes and intent of said Chapter; and, WHEREAS, the Board of Directors ("Board") of Kootenai County Water District No. 1 ("District") has reviewed the occurrences of water service interruptions to Patrons in the past several years caused by system failures and emergency repairs to the plant and distribution infrastructure, and determined that further strain on the already compromised Water System has high risk of accelerating further failures; and, WHEREAS, the District needs to serve the interests of its current Patrons who receive water, said Patrons receiving water for primarily domestic and stock purposes; and, WHEREAS, the Board of the District has made legally-binding commitments to persons and/or entities for service of water from the District; and, WHEREAS, the District intends to continue to provide service to its current Patrons and honor its commitments to those it has made such legally-binding commitments to; and, WHEREAS, the District intends to issue further water service hook-ups to patrons eligible for such hook-ups; but needs to do so at a time when the District can be reasonably assured that the health, safety, and welfare of all patrons can be protected; and, WHEREAS, this Resolution has been authorized by motion and second duly made at a special meeting of the District's Board, held June 29, 2021, authorizing the District's attorney to review said Resolution and upon review for accuracy by the District's President and Secretary of this document in compliance with the oral motion and second made, the Board has authorized said President and Secretary to execute this Resolution; NOW THEREFORE BE IT RESOLVED: Based upon review of the occurrences of water service interruptions to Patrons in the past several years caused by system failures and emergency repairs to the plant and distribution infrastructure, and the determination that further strain on the already compromised Water System has high risk of accelerating further failures: A. The District observes and takes notice that people and animals need water for basic survival and DECLARES there is an EMERGENCY threatening the health, safety, prosperity, security and general welfare of the inhabitants of the District; and, B. Based thereon, a TEMPORARY SUSPENSION OF WATER HOOK-UPS, effective June 29, 2021, is declared, such TEMPORARY SUSPENSION shall continue until repealed by resolution, suspending new water hookups outside those the Board of the District has already made legally-binding commitments to, a list of such persons and/or entities is appended hereto as Exhibit "A"; and and/or, C. If any person and/or entity and/or believes they were inadvertently left off of such list appended hereto as Exhibit "A," such persons have thirty (30) days from the posting of this Resolution to petition the Board for inclusion on such list; and, D. After the expiration of thirty (30) days, such list shall be presumed to be correct; and, E. The District's Water System Operator shall be prohibited from hooking up new Patrons not on the list of Exhibit "A" until further notice; and, F. However, the District's Water System Operator is directed to compile a list of persons and/or entities who come to the District petitioning for service, such list shall be in chronological order according to date of application; and, G. Upon a resolution lifting the TEMPORARY SUSPENSION declared herein, such persons and entities who are named on the list compiled by the Water System Operator shall be entitled to hook up to the District's system in the order they are listed. Failure to pay the necessary fees and costs associated with hooking up to the District's system after fourteen (14) days of being notified of their right to be hooked up to the system shall forfeit their place on the list. After all persons and/or entities on said list are hooked up, the District shall then continue to hook up new Patrons on a first-come, first-served basis. H. This Resolution shall be published on the District's internet blogsite, and posted outside the District's office giving notice to all. IT IS SO ORDERED. Executed this day of July 9, 2021.
