CANCOURSE: Speak up now
“Cancourse” is a privately owned recreational facility on Canfield Mountain. The owner of subject property has been charged with violating Kootenai County Land Use and Development Code for operating a privately owned recreational facility for public use without a Conditional Use Permit. The owner is challenging that requirement at a hearing Thursday, Dec. 19, at 6 p.m. in the Kootenai County Administration Building.
The only issue to be discussed at that hearing is whether operation of a privately owned facility for public access requires a Conditional Use Permit. Merits of the facility or its activities will not be discussed.
The subject property is zoned Agricultural Suburban, suitable for residential and small-scale agricultural uses. Commercial uses, including recreation facilities open to the public, in areas so zoned are prohibited unless operated under a Conditional Use Permit.
A Conditional Use Permit would specify measures to facilitate safety for people and adjacent properties and include fire prevention/mitigation, hours of operation, and control of vehicular traffic, parking, noise, trash, location of trails, etc. I believe the property owner should be required to accept the Conditional Use Permit for reasons stated above.
Please advise the County Community Development Coordinator at 208-446-1070 or [email protected], or via U.S. Postal Service to Community Development, P.O. Box 9000, Coeur d’Alene, ID 83816 to advise him that you do NOT support the applicant’s request to be excused from the Conditional Use Permit requirement. Your response to Community Development Coordinator is requested by Dec. 9.
