ORDINANCE NO. 525 CASE NO. ZON18-0008 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF KOOTENAI COUNTY BY CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY WITHIN THE UNINCORPORATED AREA OF KOOTENAI COUNTY, IDAHO; REPEALING ALL ZONING MAP PROVISIONS IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Hauser Joint Planning Commission held a duly-noticed public hearing on June 12, 2018 for Case No. ZON18-0009 and made a recommendation of approval on said application; and WHEREAS, the Kootenai County Board of Commissioners held a public hearing on September 6, 2018 for the same request after receiving the recommendation of approval from the Hauser Joint Planning Commission and issuing an Order evidencing the reasons for approval; and WHEREAS, during the aforesaid public hearing, the owner of the property affected by the request stated that he was willing to waive the four-year vesting of this rezoning provided in section 67-6511, Idaho Code, in the event of a rezoning of all parcels located within the Hauser Area of City Impact; NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Kootenai County, Idaho: SECTION 1. AMENDMENT OF ZONING MAP Case No. ZON18-0009, a request by Gary and Stephanie Martin Revocable Inter-Vivos Trust, to change the zoning classification, of their approximately 55 acre parcel, which is currently split zoned with Upper Watershed and Lake Village, to entirely Lake Village. The parcel number is 51N05W-07-2020 and described as: Government Lot 2, except platted portion and except tax numbers in Section 07, Township 51 North, Range 05 West, B.M., Kootenai County, Idaho. SECTION 2. WAIVER OF VESTING This Ordinance recognizes that the four-year vesting of the rezoning approved in this Ordinance has been waived by the owner of the affected property in the event of a rezoning of all parcels located within the Hauser Area of City Impact. SECTION 3. REPEAL OF CONFLICTING PROVISIONS Any previous zoning classification for lands described in Section 1 of this Ordinance is hereby repealed. SECTION 4.
