County receives 39 applications for building code opt-outs

The county’s new ordinance allowing residential property owners to opt out of building codes went into effect Monday, April 30.

“While property owners and county staff are still navigating the various nuances of this new option, generally, the activity has been robust,” said a news release from the county commissioners’ office.

- During the first week of implementation, 39 opt-out applications were received, including 14 single family dwelling construction projects; the balance are for accessory structures and other property improvements.

- The opt-out provision is available only to property owners who are planning to build or improve a residential structure on property in unincorporated Kootenai County (parcels within city limits are not subject to the opt-out provision).

- In order to exercise the opt-out provision, property owners will need to apply for that option. Application forms and fee structure information are available in the county’s Community Development department. The fees for land use applications and other community development fees can be found at www.kcgov.us/departments/planning/devcode.asp.

- Property owners who apply to opt out will still be required to meet State of Idaho requirements for electrical, plumbing, & mechanical permits. Panhandle Health District and Fire District requirements will still apply, as well.
