POST FALLS — A man on felony probation was arrested on Sunday for injury to a child and petit theft after allegedly fleeing the Walmart on Mullan while being questioned about fraudulent activity.

According to police, James Dale Pass Jr., 26, Post Falls, was attempting to get a $37 refund on an item that he earlier stole. He also had a receipt from an earlier purchase on the same item.

Pass, who was on probation for drug and robbery charges, also had a 3-year-old boy with him at Walmart on Sunday.

Pass allegedly gave Walmart's asset protection staff a false name when he was questioned.

As Pass was being escorted to Walmart's asset protection office to be further questioned about the possible fraud, Pass took off running with the money and child in his arms.

A different officer later contacted Pass who was walking on Forsythia Circle north of the store. The child had on a light hooded sweatshirt and no hat or gloves in 34-degree and snowy weather. The child had been outside for about an hour, police said.

The child was given a blanket and turned over to his mother.

Pass was booked into the Kootenai County jail on a probation agent's warrant, injury to child and petit theft.
