GUNS: Should be OK on buses

| August 14, 2013 10:57 PM

I wanted to talk about a matter which I feel needs some attention. The Citylink Rider Policies and Regulations, available at http://www.idahocitylink.com/policies.php, state that: No firearms or weapons are allowed on the bus.

I feel this policy is in direct violation of Idaho Code 18-3302J: PREEMPTION OF FIREARMS REGULATION. In section 2 of the above code it states, “Except as expressly authorized by state statute, no county, city, agency, board or any other political subdivision of this state may adopt or enforce any law, rule, regulation, or ordinance which regulates in any manner the sale, acquisition, transfer, ownership, possession, transportation, carrying or storage of firearms or any element relating to firearms and components thereof, including ammunition.”

The Idaho code specifies that no government subdivision may make any policy which regulates, in this case, possession, transportation or carrying of firearms. As the Citylink program is a partnership of local and state government agencies, it falls under this code.

Additionally, on the FAQ section of the website (http://www.idahocitylink.com/info.php) it specifically states that legal concealed carry permit holders are not allowed to carry their weapons on the bus. This specific policy is in direct violation of Idaho code 18-3302C which defines the only places where concealed carry is prohibited.

Since carrying a firearm or weapon is legal according to state law, the Citylink policy banning riders from legally open or concealed carrying firearms and weapons should be removed. It is important to protect the rights we enjoy as Americans against even small violations such as this one.
