LAWSUIT: Kroc should foot bill
I have found it less than humorous to read the follow-up letters regarding the couple that has filed suit on the Kroc Center. Somehow assumptions and opinions have been made that simply are not based on the total picture.
The couple in question tried for many months to simply have their medical expenses covered that resulted from the fall. They are senior citizens who were honest in their requests which were denied. They were told by Major John Chamness when the accident occurred that they (the Kroc Center) would do whatever was needed to pay for medical costs. However, the Kroc Center appears to be self-insured and all attempts for help were denied.
She tried to avoid this very thing for months but with surgery, physician expenses and physical therapy and still permanent suffering the many of thousands of dollars in bills made the options run out. It was with great reluctance that this suit was ever filed.
As most of us know, when a suit is filed the attorney includes all possibilities and resulting damages. Their personal life under public scrutiny has been most humiliating yet the advice they received from the Kroc Center's director, to just turn it in to Medicare, was not an honest option nor would it begin to include the costs incurred and the amounts the physicians would have been requested by Medicare to charge off. This was not filed to make a killing financially at the expense of the Kroc Center and would never have happened if honest recompense for the medical expenses would have been honored.
I too belong to Kroc Center and greatly enjoy its presence in this community but they truly should be like any other business providing insurance coverage for accidents on their premises. Most of us even carry insurance for such accidents on our homes let alone a business that focuses on physical activity!
