Charges in fatal crash undecided

COEUR d'ALENE - It has not yet been determined if the driver of a motorcycle involved in a fatal accident on Monday will be charged with a crime.

Idaho State Police said the investigation into the accident continues.

Garrett Kienke, 20, was driving the Suzuki around 7:20 p.m. at speeds estimated up to 45 mph in a 25 mph zone. He and Justin Allen, 20, of Coeur d'Alene were thrown from the bike when Kienke lost control braking for traffic at Ninth Street while westbound on Lakeside Avenue.

Allen died from injuries suffered in the accident. Neither was wearing a helmet. Kienke remained in fair condition at Kootenai Medical Center with undisclosed injuries on Thursday.

Kootenai County Prosecutor Barry McHugh said any charges filed would follow the report from ISP, but would likely come within a few days. He would not speculate on what charges could follow until the investigation is completed.
