Magistrate's wife sentenced in burglary case

POCATELLO (AP) - The wife of a magistrate judge in eastern Idaho will serve at least two years in prison for breaking into two homes to get prescription drugs.

Marian Evans, 56, was sentenced Friday in 6th District Court, where her husband, David Evans, is a magistrate. She was charged in November with two counts of felony burglary.

The Oneida County Attorney asked the Idaho Attorney General's office to handle the case to avoid potential conflicts of interest.

Prosecutors dropped one of the burglary charges as part of a plea agreement in December with Marian Evans, who expressed remorse for her actions.
