KTEC: Questions about governance

| August 13, 2010 10:00 PM

To Tom Luna, Superintendent of Schools: I missed your meeting at the MICA Grange. The questions I have may have been asked so I apologize for not knowing, but no one I've talked to seems to know as well.

I am wondering about the accountability to the taxpayers for the proposed governance of KTEC. According to news reports the three school districts' superintendents and two business owners will comprise the executive board and a 21-member advisory board comprised of business owners will make day to day ground level decisions on the operation of KTEC.

My questions are:

1. What statutes authorize the governance as proposed?

2. What will be the process to select the two business owners for the executive committee?

2a. What are the responsibilities of the executive committee?

3. What will be the process to select the 21-member advisory board?

3a. What will be the responsibilities of the advisory board?

4. Will the 21-member board be advisory or deciders? (Making ground level decisions is not advisory.)

5. How will the proposed governance meet the statutory definition of public agency?

The Idaho Open Records law and the Idaho Open Meeting Law apply only to public agencies. Budgets and policy are decided by an elected board of trustees.

6. How will elected trustees from three different school districts be held accountable to the operation of KTEC when voters are limited to only five of 15 trustees?

Tom, I hope you agree that the answers to these concerns need to be clearly defined so the voters know what their vote will empower. Please respond quickly.
